How long do I hafto wait to receive backdated pip after tribuneral win?

I won my tribuneral a week ago today and still haven't had any letters or payments I'm owed 8 months backdated pay but still not a penny and no word, can anyone tell me how long it takes to recievev any kind of payment after winning a tribuneral?

Hi CupiddipuC congratulations on winning your tribunal and seeing it through to the end. I have not done one yet so I am sorry I cannot answer your question but friends on here have and I'm sure they'll fill you in. x

Hi yes the rules have changed they only backdate to the time you put your form in or the max I believe is 3months? Unless you were not in receipt of Dla then they back date longer time period.

I found this;

' Claims for PIP cannot be backdated before the date of your claim'

I never got a thing as I was still getting Dla even though it was a lower rate. Apparently you can't be in receipt of Dla & PIP at the same time, one has to stop before the other starts. I know many have waited between 21-28 days for their first pip payment.

They just make up their own rules!!!

No first time I ever claimed pip so does that mean I'll get all 8 months? And when will I get my backdated payment owed?

I made my claim in march its now December so I'm owed nearly 2500 in back payments

Here you go from a benefit & work site;

'the rules are different depending on whether it is a new claim or a transfer from DLA. In the first case the payments are backdated to the start of the claim'.

Been a big fuss about original Dla claimants missing out on backdated cash but yours is a new claim, not transferring from dla.

Hope you get sorted soon be nice for Christmas let me know how you get on. I would call them too speed it up a little.

No you don't even get your money back dated if your going to a tribunal because it's actually another person making a decision on your eligibility to receive pip you only get money from the day that your awarded the claim not from the day that you make a claim like the old dla backdated moneys while they processed your claim mine went into thousands when I first got dla backdated with pip I got a partial months payment from the day they awarded it to me. I am not 100 per cent sure about this, but I think the DWP changed the Rules about back dating benefit awards.

I thought that they were only back dating up to 16 weeks now.

The closest to an answer that I have found on the internet is from the *CAB and I have pasted this below for you. None of the other websites appear to have an answer:

*If you win your appeal

If your appeal is successful, you’ll get an official notice in the post within a couple of weeks. You’ll receive your new amount of money every 4 weeks.

The DWP will also have to pay you everything they should have been paying you from the date of your claim. It normally takes 4 to 6 weeks for this money to come through.

Hi I was awarded my PIP and I received my back dated money and monthly payments 4 weeks later. I got my backdated money, I think from when they received my form. I was told that it would be from when I made the phone call to get my form but I don't think it was. I hope that this is off some help to you.

Congrats dwp say it's about 28 days because they have the right to appeal the decision too, you should get a letter informing you of how much of back dated monies and when they are to go into your bank around this time too,

They only have a right to appeal the decision if there is a error of law but I had a doctor a judge and a mental health professional on my panel so I highly doubt there is any error of law for the DWP to challange that award down247 let's not go making people anxious mate.

I had the same , I also wondered how long be for id get payment as it ha been 42 wks at my appeal so I asked at the end and this is what they told me , only passing on info told by officials ,

The award of a PIP claim after a tribunal should be paid from the date of the initial application. Presumably less any DLA payments where relevant. Recent experience has been that payment of the new rate will start after they notify you that your appeal has been successful and any arrears will follow within about 6 weeks. They can sanction and stop payment in 24 hours but are reluctant to pay their debts with such alacrity, which demonstrates the mind set of the DWP.

Hi

You should receive the whole amount due to you but it can take several weeks to get everything. Fingers crossed you get it before Christmas ( I would cross my fingers but not able to ), that would be a welcome surprise for you.

Also for anyone who is nit in receipt of careers allowance, I mean someone claiming for you there is a severe disability payment which you should be claiming, thus is also backdated to your original claim date. I received £3000 in payment and it adds an extra £60 weekly to my benefits it's very welcome and much needed.

You will get it all and sometimes you have to wait a year before back payment and then your benefits increase also and you will get a monthly payment of PIP

Hi guys, thought I'd update everyone after all the mixed comments, I just had a phone call from DWP (8 days after tribuneral) and they said I'll be payed my pip end of this month and also my 8 months backdated is being played into my account in the next 3-5 working days. So in all after my win at tribuneral it will have took 2 weeks at the most to get all money owed and monthly payments as well.

It's not guaranteed that you get any backdated moneys full stop I got the top rate of pip the enhanced rate and they only gave me from the date that I was awarded it not from the date that I made the claim. I'm just letting people know that it does not work like disability allowance at all so do not expect to get 8 months back pay if it's a new claim as I was told you won't get paid anything only from when they say yes on your pip claim and at which level so I got about 2 weeks backdated money from when I got my enhanced pip certificate until the date the money went into the bank so no big payments I'm afraid unlike disability living allowance claim.

I think youve been screwed over then as my new claim i did a few years back i got backpayed from the day a called for the questionaire and ive just won a tribunal that has said to pay me 11 month backdated

I won my tribunal appeal four weeks ago i. Had a phone call from them Monday asking security questions but still no money

My letter at time of tribunal says back dated to Nov 17th last year but I don't think I'm getting that but at this present moment I would take ten pounds!

The wait is getting desperate.
