yes u have guessed it i won my appeal got the letter today and cant believe it, I think if u can make it to the tribunal its so worth it to get ur side over soooooooooo happy x

Congratulations. But I would not celebrate just yet, if I were you. I have this sneaking suspicion that Atos will be calling you in for a re-assessment soon. That is the way they work. They could in theory, assess you four times a year. But I hope sincerely, this is not a short-lived victory.

the judge has wrote that i cant be assessed for a year from the date of the tribunal so just let them try.

I am not sure this will hold up. Atos are a law unto themselves. I know people who have indefinite and lifetime awards, but they will be reassessed. There are cases where someone was assessed as fit, went to tribunal, unfit, atos called them back and assessed as fit, back to tribunal, unfit. The man was about to do it all over again, but he died because the stress on his weak heart was too much, just as his heart specialist said would happen. Atos do not care. Apart from which, the government could just re-write the law to ensure you are assessed soon. They have done this for other things. I really hope that you are not assessed for a year, but do not hold your breath.
