I have just received my report from ASOS as I requested it after my assessment and I’m absolutely fuming. Everything I have read is total fabrication I can’t believe they can get away with this. They have got everything wrong all they say is due to ...... it is reasonable to assume the claimant can do the conga climb mountains and do the can can. They don’t know me at all and an assumption means they are guessing I can do certain things ???

If your report does say that you have grounds to sue xx

I afraid mine was very similar using the phrase ' on the balance of probability' we are now going to MR. I know it is very distressing but try to press on and fight back. Also dwp lost alot of my paperwork so it is worth checking everything is logged on their computer.

You MUST take copies of everything you send, they lose things all the time!

We ALL get zero points. And we ALL get the lies written by the so-called "healthcare professional". You're in good company.

Phone the ESA contact centre and ask for a Mandatory Reconsideration.

If they try to take down the reasons why you want your claim reconsidered over the phone, then tell them you'll need more time and that you wish to send your objections in writing.

Meanwhile, if you've got no money to live on, you'll probably have to sign on for Jobseekers Allowance or Universal Credit at the Jobcentre. Although you'll be treated as Fit for Work, they will make allowances for any medical conditions, so you won't be sent on work experience with the army or anything like that.

Stiff upper lip and all that,

If you have failed your Medical, Appeal. List all the errors and list all your Disabilities etc, even send medical evidence for them to reconsideration. I got refused twice as they tend to back up the Assessor. It could have changed now,,I did it in 2016. I had to go to Court although I was too ill and sent all the information I supplied to them plus my Appeal Letters and Medical Report. The decision was overturned. Showing all the errors I sent to the ESA ( in my case) helped. The ESA instructions told the Assessors they must refuse most people whether they deserved it because of their Disabilities or not! Don't give up they count on you doing that and saving them money!

I agree that they have to refuse people in order to save the government money and there are some that fake certain illnesses. I just get so annoyed with being continually assessed for my illnesses which are progressive and each time the decision is different. I had my esa assessment prior to the pip and both reports contradict each other? So esa agree with me and were so sympathetic only in there 10mins BUT pip I was in there ages and asked to do certain tasks and she was like hitler. My report from pip states I looked extremely well not nervous smiled appropriately and answered the questions. Well what was i meant to do sit there and bloody ignore her? So because I smiled I got zero points on one section.

They don't have to refuse genuine Disabled people they just do that. I had 10 errors? on my Medical which they totally engnored. They have a set large number that they refuse each day, so bad luck if you arrive later in the day and their refusal number haven't been reached. You are doomed before you get in the door. They should save lives not money. At the same time my ESA was on £9.99 a week, again they engnored all my letters, phonecards and also every agency who contacted them on my behalf, even lying to one that the money was going to be paid (3 months later and nothing happened!). I went through a breakdown because of the Appeals, Court Case and not having enough to live on (had food parcels). Only an M.P. finally got money, he managed it in a couple of weeks! Now the Government are saying M.P.s can't be contacted. So would I 2 years later still be on £9.99 a week?? If I swore the Government would have a few choice words from me.

Meant to say they left me on £9.99 for 8 months in error! No mistake there just cruelty!

Well I’ve been through two appeals before and I too ended up having a breakdown through the stress and my illnesses got worse. I will probably now have to go through the process again soon I just don’t think I could cope doing it all again.

I know I dread brown envelopes coming through the door! I had to go to Counselling to stop the terrible worrying the ESA started. Sadly I had too much evidence of things going wrong. I'm hoping if I get called for a Medical again (I have 1 year and 9 months before Retirement) I will cope because last time I had the added stress of living on £9.99 a week ESA for 8 months during the process. We need to just go ahead with the process or they win!
