Thanks Ian thats really helpful. It is not the same file wish I could attach it. It gives step by step information on how to deal with each form of discrimination also mentioning the Disability Discrimination Act and conciliation and third party advocacy.

Have you a link for the pdf download as file attachment is not possible even in the message system, unlike e mail in that.

It could be because I'm using my mobile so I will try on the computer just had a light bulb moment lol I've never really manged to export PDF files on to this site.

Hi,

Brilliant for everyone to be aware of their rights.

Unfortunately when my rights were reminded to a large employer (some time ago now) they walked all over the discrimination act. Even one of the largest unions (supporting me) said employment laws generally supercede ....and they did 😓.

That said, the more the act is attempted to be or successfully used, the more employees will have awareness of in the future.

Oh sorry to hear that I like to hope it's getting better with time. Did not realise how much I would be up against it in college.

I'm thinking of using the discrimination act to help with problems at college my union reps thinks I should make a formal complaint. Lead Scotland the equivalent of disability rights uk helped me through email and advised that even the mention of discrimination could put it right and if not I should write a formal letter of complaint to the college principal. They can support it and If that doesn't work then I could take it to my local counciller or msp to take further on my behalf to the SPSO

I really feel for you! Such a horrible thing to feel treated unfairly and feel unable to do anything about it so many times its brought me to tears and close to giving up.

Hi MsBrightside,

You certainly should take it further at college as the more it's pushed the more organisations will be made aware of it and adhere to it.

Unbelievable my employer was part of the largest health organisations (three guesses). They didn't even have disability policy. They ignored and walked all over the discrimination act. Eventually I was ill healthiest contract ended. To be honest it was the best thing for me with my health. Apparently they are still flaunting the act though 😠. Should b ashamed of themselves.

That is shocking! Yeah I get what you mean sometimes rest is the best thing I had to stay off toady which is really not helpful. But I had been out 2 days and a row so felt really run down. I did plan on going but lay in my bed for a second and slept for 4hrs. As the day went on I realised rest was what i needed and was best to study at home tho I worry about falling behind.

I do think I should just say what I think of their manner of handling my situation in a stressful long drawn out process. I never know where my next payment is coming from. I don't know how to play it though should I be generously resonable with them and give them a chance to resolve it mentioning if they don't I will take action or should I just think nope I don't want anyone else going through this and remember I've gave them enough chances and just write straight to the principal to mention he should have a good long look at his professional procedures for handling such matters I felt there was no guideline for the staff to follow from Bursary to tutors they did not know what to do with me.

Thanks my aim is just to complete the course and pass! Though it's harder than I imagined I'm thinking of applying for next year as the financial side might be slightly easier.

Another point to mention but may only be me.. having been diagnosed only in the last few months properly (almost took 2years including on set.) I never considered myself disabled though when you think about it is quite apparent that is so. In this file it states any mobility issue, on going condition could class you as disabled. So I possibly should have applied for DSA at the start of my course.

Employers, especially government ones still discriminate and dismiss under Capability grounds. My husband who had Sleep Apnoea, Diabetes, Sciatica, Asthma was dismissed. Even though his employer had a clause that time taken for illness due to recognised disabilities or for treatment should not be counted when assessing attendance. His Cpap machine broke and it took weeks for a new one, so he was not able to drive which was a major part of his job. He requested work which he could do from home but they refused. We argued that the use of a cpap machine constituted ongoing treatment and expecting a 97% attendance was unfair as they gave no consideration for his disabilities. Also he was due to have bariatric surgery and they were not prepared to keep his job open for the time he would have his surgery and recover. he was dismissed.

He luckily found another job with an employer who recognised and made allowances for his conditions. They did not count his time taken for the surgery as absence. His diabetes and sleep apnoea disappeared and he has not had a single day sick in 3 years.

Sorry, he had such an awful time people just don't understand sometimes and don't realise how much it takes for us just to do the simplest things never mind work.

Yeah I feel like they just hoped I would leave. My main point would be how much it had affected my overall health. I think without the stress I wouldn't be needing an urgent neurology appointment and would be ill less often.
