Thanks to all of you who supported me through my PIP over the last year. This week I went to Tribunal to get my mobility component changed from standard to higher and lost. I’ve been on DLA higher mobility for 28 years and so this is a blow. I have no idea how to cope with my illness without my car. My advisors have said to get a statement of reasons from the court and then to decide if I want to go to higher tribunal if there’s a case, which would last another year and would mean being in court with a panel again. The thought of attending a panel again is absolutely so frightening to me as I found the whole thing completely harrowing beyond belief and demeaning.
Have any of you been in this situation before? What did you do? Did you go to upper Tribunal? Did you win? Is it worth it? Will Motability allow me to keep the car till the upper Tribunal or is this the end of their support?
Thank you to all of you for your amazing support!
God bless xxxx

No mobility will give about 2 months I think before ,either you can buy the car from them or hand it back to them ,this happened to me 3 years ago ,really sorry to hear this happened to you ,really hope you can sort it out !
I don't have lupus, but I just had my tribunal decision set aside (you can ask for this separately if you think there was a procedural error). I also applied to upper tribunal but the courts went with the setting aside because it was simpler I think.
When I was preparing to appeal to the upper tribunal, I found Scope had good basic information about it. One tip is that if there are errors of fact in the statement of reasons, that may be an error of law if they based their decision on such factual errors. I just went through the statement of reasons and looked for errors, misinterpretations, assumptions etc and backed it up by referring to my medical evidence. I didn't have a lawyer or any help. I can't say how successful I would have been, but it is certainly worth a try.
The other option (although you could do both) is to submit a fresh claim.
