ESA decision........

i Have fibro in most joints now, lower spine injury and fatigue.... I would class myself as bad with fibro, 24/7 pain and on 12 pain killers every 6 hours. Got DLA now for 5 years ( till this new one comes around lol) and they put me in the middle ESA group, work related i think its called, have to go for interviews. I appealed and done research via the internet and a few legal forums i belong to and after a 7 month wait i WON and i am now in the first group were they leave me alone for a year and if no change carrys on.

There is hope, but i tell everyone, do not just fill in the form and hope for the best. research research research. There are many forums were you can find case law or a rule or law which can win your apeal or application with certainty and not just leaving it upto some desk jockey who might have had a bad day and decides to fail you, or simply puts your form in the fail file without even looking at it properly.

Good luck and now i am off to bed after seeing my daughte roff to school. tired and need some sleep, even if it is from medication.

Congratulations, I am still in the process of asking for a reconsideration, and I often feel like giving up, but your story gives me hope. I do agree you cannot beat these people without research what worked previously just wont work now. Good luck XH

HI so what happens after a year will you get sent for another Atos assesment or an interview at the job centre to see about if you have had any changes or improvements as to whether you remain in the support group or not.......... as I have the same result as you.

I was put into the support group for a minimum of one year with a review in the mid term my letter said which is basically a visit to the job centre and a chat or something not sure i am awaiting a letter about the mid term review as my year is up in early july did any one explain what will happen to you no one did say much to me about when the year is up i presume to be sent back to atos ......

. i dread walking passed the job centre let alone going in there people on job seekers they treat like scum and seems your constantly bullied and threatened with having your money stopped which means no housing benefit as you have no income too i was threatened like that for four months the advisor made me so ill i was put back on the ESA went to atos nine months later and was put straight in the support group my report said i trembelled through out the entire interview was of unkept apperance i remember i stuffed up the movement actions i was asked to do and completely broke down in tears by the end of it and a lot of it was due to the way i was treated by the jobcentre who completely ignored the medication i was on and that i was even ill all I had from them was you signed the form to say your fit for work was constantly rammed down my throat when i said i could not do driving work as i was unsafe and taking to much medicine and the atos medical came nine months later from being on job seekers and that was still the state i was in i had to take my letter to a neighbour to read as i could not believe it said support group i thought it would be saying job seekers again i think they way people are treated is sickening fills me full of fear when my year is up so does any one know the precedure from the support group when my year is up it did state minimum of one year ?

it will be another form to fill in, but if you fill in the form exactly the same as last one and add a note to say nothing has changed and you are currently in the support group then it will stay the same. BUT and i know this is important from personal experience, make sure you put that extra note in the blank box that your same and are in support group, seems when they check these forms they do not know what group your in and treat it as new application. So make sure let them know.

Seems though we jump and clear one hurdle and we now have this pips for dla as our next hurdle. We shall see if they back down any on this with all the pressure being asserted or they carry on.

Hi Madddy thanks for the reply I will take your advice and hope for the best and make sure I state im in the support group and no changes to my symptoms .... i doubt they will change their criteria they are still complaining to many in the support group and the same with the work related group and yet some people they said were fit for work were refused job seekers because of the amout of disability they had said no one would employ them I dont get DLA i applied once was turned down didnt bother to appeal as it seems such a rare thing and a whole lot of stress to go through to get it and i really dont need the worry of the whole experiance hanging over my head ..... i got on the bus once with my disabled card they gave me and the driver said well you dont look disabled i replied why because im not dragging my Fxxxxxg legs behind me i only go out when i have to prefer it that way left alone to my own devices so to speak people say being ill is a free ride well its not a ride i have ever enjoyed anyway many thanks for your reply xx
