Unfortunately ESA can be income based unless you are in the Support Group or paid enough NI recently to be Contribution based, either way savings and income will affect your eligibility.

If you say you are living at your partner's for four or more nights a week then her income and savings will be taken into consideration. This is because it is the combined household income, not personal income. Anything over sixteen thousand pounds means you will not qualify. PIP is not means tested so this is not counted in your total income.

I seriously suggest you make an appointment with the Citizens Advice or contact Janet our benefits advisor.

is a good place to start.

Hope it all works out in your favour.

Hi stevenj

As our Kay bluebell99 has said, anything over £16,000 in savings will definitely preclude you from claiming certain benefits.

The CAB is the best place for specific benefits questions. They are able to go through everything with you and check on their computers what you are entitled to claim.

Good luck

As far as I understand the rules u less she has the £70,000 in something like a Personal Injury Trust it will be counted as savings and as the others have said if the DWP do decide that you are technically living together and you are on Income based ESA it will be your joint income taken into account. You need to take advice from someone like the CAB. Benefits and all the rules are an absolute minefield and it is how they interpret the rules and your circumstances. Do let us know how you get on.x
