Hi Mollymay I can understand why you are not with it as it is such a disappointment when you get turned down. Your next step is to appeal to a Tribunal. If you go on the Gov.uk site and type in the search box Appeal to the Social Security Child Support Tribunal it tells you all about the process. I had to go twice with my OH when he had to appeal against their decision not to give him ESA.
I don't know whether you have access to the Citizens Advice Bureau or any Welfare Officer or if you are a tenant in social housing there are sometimes people who can help fill in the forms. You need to put down clearly why you disagree with the decision. if you haven't already got it you must ask for a copy of the assessment and then really look at it rationally. see where there are discrpencies in what they said you said and what you did and also make sure all meds etc are listed correctly. The nurse who Aassessed my husband concentrated on the physical side when it was a mental health issue so we had her straight away. She also put down the wrong medication and dosage even though she had a green repeat prescription form in her possession, these are the things the tribunals absolutely hate to see and they start to come on your side.

I have just gone to court this week took a diabled advocate with me should get the letter tomorrow or Monday ,it's not easy to appeal but you have to fight this read somewhere that ATOS is only passing 37% of applications ,it's not right but what can we do !!!!

Thankyou I got rushed to hospital Wednesday with chronic migraine and sickness thought I was having a stoke coz the migraine was on top my head and the sickness was really bad. I'm seeing my doctor Tuesday they took loads of test even done a lumber puncher I was really scared but I will fight this it isn't fair thankyou for replying xx
No it not fair I agree ,I have just gone through a first tear tribrunal and been refused,but points are 5 and 4 , so I am going to see on Monday.

On another note, take some time for yourself. It is normal and understandable to feel what you are feeling after having the Mandatory Reconsideration turned down.
When you have a moment, just have a think as objectively as you can and ask yourself a couple of questions regarding your claim.
1. What do I want to achieve?
2. How reasonable are my expectations?
If you are clear on your goals and your expectations then make the decision one way or another. Stick with that decision if you can. It will make life a lot easier.
The process will take a lot out of you both physically and mentally.
However, if you are clear in your goals, reasonable in your expectations and understand what it is going to take then go for it!
