PLEASE CAN ANYONE HELP ME WITH THIS I had my ASO medical Feb 20th obv I failed so put in my appeal . I have just had a letter del with over 30 pages which include the form unfilled out before the medical, my appeal papers and the report from my medical . The letter says my appeal papers were looked at April 3rd and the decision stays the same, the decision of 27th Feb was reconsidered on 3rd April but not revised. They say they have sent a copy of the info & my appeal letter to the tribunals service & they will get in touch with me to tell me what happens next . So does this mean I am now on longer entitled to ESA ? or do I now have to wait for a date to attend a tribunal ? Hope someone can help me with this.

if you have said you want a tribunal ,the tribunal will get in contact with you direct and send the relevant forms to you ,the dss should have asked you if you want to take it to tribunal,they usually reduce you money until the appeal is held and if you win they back pay you any money owing while you were waiting.I had to wait nearly 9 months before my appeal was heard but i won it and it was another 8 weeks before they sorted money out.hope this helps
Thank you , yes it does help. So far all I've had is a letter from the job centre , they sent me copies of the medical I attended , x.at tosh u.at was, they also sent me the form I filled out before the medical , a copy of my letter telling them I was appealing . So now I just have to wait until the tribunal place gets in touch . So far my money hasn't been lowered though I'm still getting the basic ESA benefit £71 per wk . I find it amazing Thu after my medical had ended I went to the loo and even this was noted !!!!!! the medical form said I was able to self toilet !!! This , to me is so wrong considering the medical was over , I had left the room & was leaving the building . Mind you , even my Dr said if you can hit a key movie computer then you've failed , you fail for turning up for breathing . Its wrong & pathetic the way they treat us .
