PIP appeal

Anybody in Derbyshire awaiting pip appeal ? Or have a pip appeal recently ?If so how long did you wait ?

And where about did it take place ?

Sorry you are having to go through this. I suspect I too will be in this position shortly.

They don't seem to understand how much we can't do on our bad days and seem to only be interested in what we can do on our good days. Quite frankly I feel you can't be honest with them.

I have been reading loads about the appeal process and it sounds quite positive.

How long have you been waiting?

I was actually awarded my mandatory appeal but I was still unhappy that's why Ive taken it to a tribunal .

Oh I can only but imagine.

I've been in a whirlwind of depression since my assessment last week.

I was told to apply for it through social services.

The stress has been too much to the point I had to be away from my own children because I didn't want them to see me in such a bad way. The system is failing us.

I'd much prefer health and a good career then any amount of money.

Good going you won the mandatory, that is a positive.

I went for mandatory and failed. Am now represented by Welfare Rights at the Council. Nothing heard since WR’s submission (which in my view was really spot on and included lots more evidence, but I’m told the next step is an appointment for the Tribunal, which could be something like 12 months. This is Leeds where I understand Tribunal members have objected very much to the paucity of DWP counter-claims, meaning over 75% of appeals are accepted.

I’m adding to my initial response. On the back of everyone’s total rage, stress, and humiliation about PIP, I’ve called WR to ask if anything has been missed since WR sent my submission to Tribunal in Feb and I received a complete set of every paper. The answer is “no”. If DWP write to say they dismiss the appeal, it doesn’t mean they have given in, simply that they don’t agree with the submission. Otherwise it may happen, but not very often, that DWP decide to agree pre Tribunal. Otherwise it’s a 8-10 months wait here.

In Leeds the court generally schedules 4 Tribunals a day, when they can get the right people available to judge the appeal ( hello summer hols) No worsening health can now be taken into account. If I did a fresh appeal for PIP today and passed the assessment, the benefit would be backdated to today. If I hang on for Tribunal and they uphold my claim, it is backdated to the point I was paid less. The Tribunal generally say the claim counts for two years in which time the DWP has to lay off unless I let them know I’ve improved.

I’m hanging on. The DWP reduced my care element from the highest to the middle rate, but I kept my lower mobility, and WR are more than confident there’s enough evidence to re instate the care component. In that case, the backlog of benefit will be much greater. I haven’t lost as much as others have, but was on the highest rate since DLA days and my health has certainly not improved. I strongly resent the implication that I’m a benefits dodger or liar.

Still remains a long stressful wait, never mind the Tribunal itself, as has been noted in Parliament.

I actually put in my appeal by the gov.UK website which ment my appeal got logged immediately.

I also receive pretty regular updates also which I think is much better because your not relying on the post

E.g they inform me when they have received any further evidence I send and when they receive it.

They inform me when DWP respond to anything.

And general progress of my appeal. 👍

I handed in 2 letters at my assessment which states what causes the pain in my legs and also my desperation to get out of this so I can be a normal mum to my kids. Doubt that will get handed over.

I may use your approach then if the time comes and use the gov website.

How long sorry have you been waiting for a hearing date? X

I think so!!!!!! I have just been reading their guidelines , they are not allowed to ask yes or no answer questions! this is exactly why I felt interrogated because I had no opportunity to explain anything. It was yes, no start the next question. My brain is still fried. x
