ESA Disallowed

I have just now found out that my appeal for ESA has been Disallowed, What do I need to do now? Also I get DLA, What will happen to that?

On what basis was it disallowed?

DLA isn't linked to ESA so it shouldn't affect that for the time being . You can ( in theory ) claim DLA even if you're working .

What grounds have they stated to disallow your ESA ? Have you had any legal support from a Law Centre or from DIAL or CAB or similar ?

Why have they disallowed.? Didnt they could.

I had help from my local welfare rights. I have not been told why its been disallowed, I have just got the letter today after my appeal on Tuesday. My welfare worker was supposed to phone me yesterday with the result but I have still not heard from him and I don't know how to contact him either.

There is an on line site called 'benefits at work' that I would highly recommend, also the CAB are amazing they helped me a lot. Its worth asking the ESA to look again at your claim, and get as much extra proof as you can and send to them. Talk to your GP and other health providers and ask for letters from them, ask them to send these to you so you can check them first, also letters from family and friends explaining how your disability affects you and send these too. Apparently now if ESA is not given they contact DLA. Don't give up, this happened to me and using all the above measures they reinstated my claim and even backdated it. If you ask them to look at your claim again, do it quickly and get the CAB to call them. Then you will hopefully not have to go to tribunal. good luck, Caz

Thanx for all the answers and I will fight it. Its just all this worry taking its toll and I am having some major flare ups, its my family that I really feel sorry for putting up with me. HUGS xxx

i don't understand how they can disallow appeal they are pushing people way too far . i know it is a hard fight but you got to keep going and take it as far as you can. I have been driven round the bend with worry financially for a pittance but i will keep fighting as i am not fit for work as they say. you will find info about the descriptors and points system that where posted on my question i posted which i found helpful. i have appealed and had my reconsideration turned down and will keep fighting get help from cab or another organistion who deals with appeals asap. at the end of the day if you we were fit to work we would be doing so take care lesley x

Thanx linksy the fight goes on. I have a problem, because my hubby works my loclal Cab wont help me I have tried them before. So I will have to find someone who can help. As I said the fight goes on and I will fight it all the way but it really brings a person down. xxx
