Hi Well done!

Yes in 6 months you will get another ESA form from the great ATOS and go round in circles again, I can't imagine how they think you will be fit for work in six months, perhaps they know something we don't.

I was put in the WRAG or what even it is called and tribunal said to reassess me in 1 year, which was up at the start of October and I got the ESA form a few weeks before that, I have sent it off so getting ready for my 3rd tribunal as surprise surprise I'm no better.

How long did you have to wait for your tribunal?

Hugs xx

its a long story i had my 1st tribunal last july it was adjourned because the judge wanted more evidence and arranged for a doctor to visit me and do a medical report, he was fantastic he wrote a great report all in my favour only bad news he filled it in on a DLA form so when i returned back to tribunal i was told it could not be used as wrong benefit i was gobsmacked even when i told them they had sent him wouldnt listen to me and i lost my appeal, my wrag money ran out last april so i wasnt getting any money from them.

in february i asked the dwp to look at my claim again they wouldnt change their decision and sent my claim to the tribunals, the tribunal has messed up big time with me i sent all my medical evidence to them and waited for my appeal in august, the day before it all my evidence was returned with a letter saying i had lost my appeal as the paperwork arrived to late ?? the next day i received a phone call from the court saying my appeal is being adjourned so the court can get more medical evidence , i told her if they had not sent all my paperwork back to me they would have had ample, she didnt know what i was talking about and asked if i could sent it all back to them .i received a letter off them apologising and calling it a simple misunderstanding?? a judge had looked at my old appeal from last year??? so today was my tribunal i won they apologised for the mistakes and told me that the DLA form from last year should of been used like i had told them millions of times before, anyway so in 6 months time it starts all over again its been a very hard stressful year , they just want you to give up dont they.

do they backdate our money?

hugs xxx

I Won Appeal and mine was 12 months but this was not from the judge it was the DWP that made the 12 month reassess rule which seems to be the norm now.

did the court not give you a reassess time when you went to court and won?

no it was the DWP that made the 12 month re assement
