DLA changed decision so your appeal will not continue

well dla changed decision in my favour no need to appeal, so i phoned tribunal up as already had date set, i canseld my appeal but they went a head with out my notes anyway, refuse dla what happends now, so confused about it all

I think what Tracy is saying, she appealed a decision for DLA, meanwhile the DWP decided to award DLA, so there was no need for her appeal after that. Tribunal hearing went ahead as scheduled anyway, and she lost her appeal.

I thought that was what was meant .. Surely that doesn't mean dla goes and the process has to start all over again .. Or do dla over ride tribunal decision... This is a new one on me.....

dla letter dated 19th april 2013, have also been on inter net found this,

When you ask for an appeal a decision-maker will have another look at the decision, if they have not already done so. They have the power to change it without the need for an appeal tribunal.

If they change the decision, and it is to your advantage, the appeal will stop. If the new decision does not give you everything you want you will have to put in a fresh appeal within one month of the decision.

so will they cancel my dla

Hello Tracy0770,

I think you may need to take advice from one of the organisations that are listed on the benefit section of our website, link below.

They should be able to advise what steps to take. I am surmising but they may suggest recorded letters with copies of the DLA letter stating the appeal was cancelled therefore the subsequent appeal decision is non in void.

just found this information,

The DWP will look at their decision again to see if they can change it without a tribunal. If the decision is changed in your favour your appeal will lapse. If the new decision does not give you everything you asked for you will have to make a new appeal within one month of the date of the new decision.

so it seems i need do nothing now, thank you all for your help

just an update, phoned dla decision from tribunal nil and void, as new decision in my favour, till 07/09/2017. still going get low rate mobility and medium care x
