Clinically depressed diagnosis.

Hi there,

I have suffered from depression on and off for many years and recently i got a new job which requires me to undergo screening to obtain Security Clearance because of the nature of the work i do, now as a result of this screening the MOD contacted me and asked for permission to see my medical records and the reason for it because on my ACRO Report ( a document containing every detail the police hold on you) it state that in 2009 i was diagnosed as clinically depressed. I have spoken to my GP and he never gave the police permission to look at my records nor is there anything from 2009 stating i was in anyway clincally depressed. I am now facing the prospect of being refused Security Clearance and ultimately losing the job i love. What i want to know is how and why the police have this information because A) its confidential and B) I havent had any dealing with the police since i was in my late teens (i am now 37) . I am so angry and upset that the police have gotten this false information and put it on my record without me knowing. PLease help. any advice legally or morally will be greatly recieved. regards Richard.

Hi, this all sounds very strange and in need of further investigation by an appropriate authority, in my opinion. I wonder if there's anything in the Data Protection Act that you could use to get the police to explain why they put this info on your record and where they got this info from? Independent Police Complaints Commission perhaps?

Do a "subject access request" under the data protection act for a copy of your records held by police and you should see the details. This is the uk law anyway.

They will be in trouble if inaccurate information recorded. Maybe there has been a mix up?

Your NHS records will confirm no depression and your GP can be asked to do a letter confirming this.

However depression is really common and unless you were deemed to be a risk to others I doubt it should affect your job application.

It should be relatively easy to sort this, but stay polite and in in good humour!

I am in a similar job to yourself, they can't fire you for being clinically depressed as thats discrimination under the mental health act. MOD ask as a formality if you have any medical conditions. They will even interview you with a medical doctor, they need to make sure that you are not unstable by means of national security. You will be fine.

i hope so. ive been worried sick about it however the thing thats done my head in is the clinically depressed diagnosis on my police report when ive never actually been diagnosed as clinically depressed. I have had a diagnosis of anxiety disorder and depression but that was only 2 years ago so where the diagnosis came from in 2009 is anyones guess. even my GP is baffled.

So this is something that you can sort out and get corrected now. It shouldn't be a problem. You have your GPs support and the record is untrue. You should be able to get some understanding as to how there was an entry on your record in 2009. What happened that year, did you have any police contact?However you do have a diagnosis of depression more recently as you have stated.

Maybe not in time to get the MOD to ignore it as they have already requested my medical records

Im just annoyed that a medical diagnosis should be included on a police report for no reason at all. Its not a criminal offence to be depressed so its no bussiness of the police.

There must be an explanation and there shouldn't be any significant consequences for you.
