won low rate care back dated 60 weeks on DLA tribunal but they couldn't decide on the mobility part, said someone else will decide, Anyone a clue as who this is as i thought that's what the judge of the panel decided, thanks

I got the lower care rate, they said because they were not sure exactly how much help I needed through the night, I found this strange ! but I didn't appeal, I was just so grateful, I didn't have to go for a medical, and I didn't want to rock the boat, I will be more specific the next time round,I also got the lower mobility rate, so Good luck with yours. hi,i got refused higher care rate as they explained....due to my my claim i did not need help in the night or help getting dressed etc etc..i laughed out loud i counted how many times i said i needed help..[CAB completed my forms etc] 14 times,that wasnt taking into account my doctor said it in his letter plus my mental health nurse plus the letter from my son!!!.. im lost for words!! xx
Hi all, I went to a Tribunal on the 1st March and was awarded Higher Rate Care for 3 years and Higher Rate Mobility indefinitely, backdated 50 weeks. I represented myself and was very pleased that the Panel were impressed with my evidence, in fact they were incredulous that my DLA had been reduced in the first place! It was very time consuming and stressful I admit, however, I was so pleased that I persevered ..... Like pondminstrel the Decision Makers simply ignored what I'd said, what my carers had said and even what my GP's had said! They also contradicted themselves by saying in one section that I wasn't at risk of falling but that I WAS at risk of falling in a different section! There seems to be no logic to how the Decision Makers come to their decisions, I'd just advise to keep plugging away and try not to be put off. Get help from the CAB or some Social Services departments have Welfare Rights Advisers who can help too. Good luck x
