so I have requested a tribunal for PIP case and just received a letter to say it has been adjourned because they couldn’t come to a decision and would like me to attend face to face so the can give me the opportunity to speak answer questions . Because I work as a teaching assistant and drive to work they cant come to an agreed conclusion. I didn’t attend just sent evidence etc of my fibromyalgia and anxiety etc.
I am going to attend now because I have more evidence as I now attend a pain clinic . Also to prove that I won’t to still work but how it is effecting me on a daily basis and should not be penalised for driving working etc. .
Have you come across this before .

All I would say is get someone who is au fait with tribunals and can prompt you and help you answer in the correct way. There will of course be a fee for them doing it but well worth having some of the anxiety taken off your shoulders. There are various charities and companies out there who know the tribunal system inside out. A relative of mine used a company who allowed a payment plan and he managed to get him enhanced rate on both.
As regards the pain clinic, often tribunals will not take into account anything that has happened after the initial paperwork was submitted as your assessment was done on the available evidence at that time and not subsequently and you are appealing against that decision. Please seek expert advice to help you get the best result.
hello I have an update I have received a date in March for my tribunal which they want me to attend in person so to gives me chance to express myself explain in person a few matters on my report where there was a few contradictions on evidence etc c .
I have also send off more evidence medical etc as it is now 28 months since I applied for pip in the first place . They are saying because I drive and work .. I must be fit and well and can plan a journey. I have done the same route for 20 years so it doesn’t cause me anxiety and I can hold a conversation. At work because I have worked with the sabe people etc . I am familiar to my surroundings being there for 20 years . And just because I have a disability I am an intelligent person etc x
Are you being represented at the tribunal? It’s quite a stressful and traumatic situation. An advocate can steer you and use the “right” phrases and take the pressure off by either putting your point across or clarifying the situation.
No I haven’t. I will be taking my mum who helps me daily etc . However things have changed with her health and she is unable to help me with my cleaning etc now .
Mostly yes. Some do payment plans some ask for donations, some take a percentage rate of back payments. Try benefits and work, scope, turn2us. My relative used a very good guy in Wales (he does travel). Contact as many as you can to see who can help.
I lost points originally because I drive but I asked them to read through it properly. And I responded.
“Yes I drive” but if you read through my answers properly you will see that I purchased an automatic car because It caused so much pain to continue to drive a manual car.
They did award me the points back.
I also lost points because they said I was smartly dressed and well kempt.
Again I responded.
“Just because I am unwell” it doesn’t mean that I no longer want to take pride in my appearance.
My partner does all the washing and ironing so what difference does it make if I am smart or scruffy.
Just because I’m smart doesn’t mean that I am not in constant pain.
I had something similar when I last applied, had the interview over the telephone and didn't get PIP. One of the reasons was because I could drive.
However someone on here suggested looking at Charlie Anderson on You tube. She gives lots of advice, look at the one for Mandatory reconsideration, very helpful.
Also I would suggest check what your GP but on the form they have to complete for PIP, mine only put one condition on. I have several disabilities she failed to add?
