PIP Tribunal Hearing

My poor husband struggling with fibromyalgia, inflammatory arthritis, fatty liver, osteoarthritis, worn disc,anxiety etc etc has just lost his tribunal. He is now applying to upper tier and has put in a new application. This has already been going on for well over a year. The judge asked questions like where does your wife work, where does your daughter work and how many hours. Do they claim carer's allowance. Asked my husband to take out his wallet which my daughter did for him and the judge asked my daughter what cards does your dad hold and when do the expire. Asked my husband could he put fuel in his vehicle etc.

Has anyone gone through this? It has just been horrendous for him and is making him feel worthless and his health is getting worse month by month.

Did a P.O. from DWP attend the hearing .It sonuds like to me they did as reasoning for all those type of questions being asked

Presiding Officer T hey are something like a senior Decision Maker who are more aware of legal points when is comes making decisions about benefits claims T he DWP have trained up a lot more of them to attend at Tribunals as claimants were winning most cases brought to appeal

So sorry for your poor husband having to endure this, it’s all bullying in my eyes. I bet if he was off his face with drugs and other things he wouldn’t even have to go to a f2f. I hope he doesn’t let this get to him too much (hard I know) but if he has appealed get all the help you can.ie Drs report and if he goes to hospital apps. I think by now Drs know they need to back up patients who are having to go through this ordeal. 🤗

I dunno, I was off my face at mine (bad back spasms and insane anxiety, so max dose tramadol and a huge dose of diazepam) and the HP said I was normal.

Absolutely disgusting ! But sadly you are not alone undergoing this sort of interragation. I was told, by a GP on the tribunal that if i could swipe on a kindle then i could get in a taxi & attend a jobcentre ? These people will say anything in order to deny you benefits to which you are entitled.

I have stopped being helpful . Now i just act bemused, which i genuinely am.

Say as little as possible & do as little as possible is my mantra now

I can’t believe they are allowed to even ask you things like this why do they need to know what cards he has and when they expire I really wood take this further good luck

Tribunals aren't part of the DWP, and they're usually (but obviously not always) pretty good. Sorry you got a bad one!!

Those questions are all related to finance, no? Weird...

Having been to two ESA tribunals with my husband which she found so traumatic even though he won in the end that when it came to my turn with tribunal he beggedxme not to go. I don't know what you put on his form but I can see the sense in some of the questions and how they were trying to trip you up as they are extremely clever and subtle in the way they do it. I do see the DWP behind this line of questioning as they are being told more and more to send representatives to sit on the panel even though a few years back this rarely happened. It resonates with me about putting in the fuel as lately I have always had to ask for someone's help at the petrol station as I can't undo the petrol cap!

You need expert help if you are going time in at Upper Tribunal as you normally only get a verdict turned around on a point of law. I do hope you can get helped you win the system isnjust inhumane.x

The Government has trained all these Presiding Officers to be at more Tribunals as too many claimants were winning there appeals. Last year one was present at my Tribunal hearing and the Welfare rights Officer who was representing me told me after my hearing that is why the Judge asked me very harsh questions., The government would rather waste money like this rather that pay money to the sick and disabled

Poor bloke he has my sympathy. But there again its easy to pick on the infirm. Disgusting treatment but no more than I expect from this uncaring crowd we now have in power :-(

The thing is they need to look at people who were on benefits from thirty odd years ago on PIPS and retired but still get the money but never get reviewed. I know of at least one person and know he has been proved fit enough to work but they are in the system and its easier to stop the new claimants like your husband.Makes my blood boil because if you are genuine you get sod all. My brother in law who had terminal cancer had to wait 16 weeks for his claim to go through even though they were told he only had 6 months to live. By the time the money came through he was too ill to benefit from it :-(

Been on this forum for years But now all I’m hearing is about disabled people treated like lies-as and theft’s

Sadly having money to live is an important part of living in a capitalist society. Money is not optional. Bills need paying, shops don't give us goods for free.The stress of losing what little we get soon dominates our lives. From application form to finally winning at tribunal can take well over a year perhaps 2 or longer. Of course people are going to vent or ask for advice. This can end up dominating our lives. It diminishes our sense of value when we are denied money to live. Worse it is too often on the basis of incorrect information and assessment. If we were important, then assessor would work hard to get it right first time. I despair at the damage physical and mental these assessments are doing. And how hard it is for those who support people going through this. How long before they can't cope either? It is very sad.

Agreed. Every time I go through it, my mental health crashes (like,, self-insuring and suicidal crashes), then my physical health crashes because I stop taking care of myself. It takes months - over a year to get better.

Gulf war syndrome, PTSD both took a while to catch on. Pooh, pooh they said. How about PTWCAD or PTPIPD? I'm amazed we haven't heard of professionals pondering these cases. Post Traumatic WCA/PIP Disorder, I suspect it is a thing, but likely, as yet, too political to mention. or just too many letters?

I've been talking about that with my counsellor. She thinks it's happening to a couple of her patients (including me).

When will they start speaking out about this or are they simply happy to make money out of the problem? Is that harsh? Dya think they can fix you when you are still at risk from the system?

Ah, but who should be speaking out? Disabled/chronically ill people have been protesting for 8 years, and nobody seems to care.... Until recently, anyway...

The therapists I thought might speak out. I'm sad our GPs don't. I've become something to process and for folks to make money from as I'm referred around. For no real purpose it seems. The system makes me more dependent than I need to be and each person seems powerless to help as they tick their list. I wonder how many folks Self harm to cope with this regime? I wonder if visible pain is a comfort for the hidden trauma inflicted by this awful system? I'm not recommending it btw!
