hello everyone. I’m diagnosed Fibro/copd which trigger each other daily , also adhd and bpd.

On my 3rd attempt at claiming pip after going through the 3 stages twice before, capita recently paid me £125 as a good will gesture for sending me another lady’s recording and not recording mine, they’ve owned up to the mistake, and redone the transcript and sent it back to dwp,

Dwp called me last Wednesday, apologised for the mess around and said he was going to award me pip, and he’s just got to investigate how much first, today I received a statement of reasons from the tribunal court from my last claim last October, I didn’t know I could get this otherwise I would’ve appealed, it’s blatant lies throughout, it even says I can’t have isolation issues and able to meet speak to people because I’ve been married!!!! Thing is I’ve never been married, so this is the bench , the 3 at tribunal which have blatantly lied, at the beginning, then later on in the report says I’m not on meds, says I sold my van because I couldn’t afford to run it , then later in the report says , I wouldn’t pay and run a van just to travel the shop 5 mins away, so I must be travelling further, so I’m able get around. But I told them it was sold 6 months prior.

So blatant lies from the 3 in judge positions have blatantly lied, surely something can be done about this? In a criminal court it would be perjury. I’d appreciate any advice and hope everyone’s ok in this crazy world.

if they sent you another person’s recording that is a serious breach of data security and they should inform the other party and report themselves to the ICO.

Hi mate, they said it’s not a breach because the woman’s name wasn’t mentioned, and said they wouldn’t inform her, which I insisted on, they did break data rules, but you know what there like,

The story is on disability news service if you go there and look up capita data breach, in the story he states the rules they broke, but DNS are only interested in printing stories, and no ones interested in challenging these ppl or holding them to account .

Just read the article on DNS. What a bunch eh? If they lost your recording that is a data breach too as they have a duty to keep your data secure and uncorrupted. Perhaps they just didn’t like the contents of the recording and just ‘disappeared’ it? I wouldn’t surprise me.

Yeah they said mine wasn’t recorded, but admitted I asked for it to be, they £125 to me so proves how much they messed up, I’m hoping the dwp guy who called me last week who said he was going to award me is doing a full investigation, that’s the only reason I can think why I got the statement of reasons from my previous claim from the tribunal out come. Just complete lies in that.

If I’m refused again after being told I’m getting awarded last week ill after seek a solicitor. 👍

Have you sought help from Citizens Advice over all of this?

I had similar many years ago, when DWP were trying to get as many people as possible off Incapacity benefit and onto ESA!

I got support from Citizens advice, as the DWP had made statements about me that were clearly untrue & dam right bizarre, saying I had two cars with gears etc, when I actually only had one and it was an auto for the sake of my health!

I don’t know where they get their lies from. The relative that accompanied me to the appointment, didn’t even recognise much of truth about me in the DWP statement, it was that untrue.

I took them to tribunal, which again was a joke, as the three ‘judges’ hardly knew anything about my condition!

But Citizens Advice were amazing & accompanied me to the tribunal, as they were appalled at the lies.

I’d contact them, then you can share it all with them & have the support & understanding you need to fight this.

Good luck, I hope you have a positive outcome in the end. It’s bad enough being ill every day, without fighting their incompetence.

I had capita lie and data breach which they compensated me for, I’m just fuming that the 3 judges at tribunal lied, saying i was married so these proves that he exaggerates not being able to socialise, I’ve never been married, they said I exaggerate my pain then later in the report, they say he probably isolates because of his serious pains, just full of contractions, I won’t to take everything to an independent court if possible, they shouldn’t be able to get away with this.

I’ve messaged cab and just waiting for a reply, I’ve also got dial helping me, I just find it strange when you point out blatant lies everyone laughs as though it’s nothing! It’s in writing so I don’t understand why no one wants to challenge it. They do it to all of us, and especially judges lying is not acceptable, gets me mad lol

I understand your frustration and anger Rob, I was exactly the same when it happened to me, then that impacts your health🙈

I had the ‘main man’ questioning me from the DWP in the area, at my appointment initially, felt more of an interrogation!

Citizens Advice told me that he was known for getting people off incapacity and onto the lesser new benefit (at the time!) of ESA!

Apparently no matter what I said, he would have got me off incapacity, as he was renowned for his high success quota locally!

You feel you can’t win with them, even though you are being truthful, if we lied like they sometimes do, then we’d be penalised in some way!

It good to offload, but so unfair you have to go through this.

I’ve only read here on the forum of peoples experiences and I think it’s awful for peoples words too be changed and make them look like they are liars 🙁there are lots of thoughts I’d like too write here but we are not allowed politics😉 but it makes me angry and sad for people like yourself. I really hope Rob things work out eventually.

Hi Rob, sorry to hear this has happened to you. Sadly I have to say these people that interview, and the people that process applications for PIP, in my opinion, and from my experience, are bare faced liars. These companies that the government employ to process this service, are fraudulent and corrupt, they did it to me, and they've done it to thousands of other claimants, the Panorama exposé a few years ago, showed the disgusting way the employees talk about people, and they get paid huge bonuses for refusing PIP to claimants, by way of lying. Utter disgrace and not fit for purpose (depending on how you look at it......fit for purpose if the goal is to lie, and save the government money). Anyway, my advice is to not give up, keep fighting them, appeal wherever possible, and also speak to the Money Advice Unit as they are very helpful and knowledgeable the right words to use, also speak to CAB, and subscribe to: benefitsandwork.co.uk/subsc... as they are also excellent.Hope this helps, Claire 🤞🏼

Thanks for replying, I should be getting it now , they can’t call say is awarding it and then not, hopefully this guy has read the statement from last tribunal and sees the contradictions, they know now, I go to papers etc, if I do get refused again this time I’ll be contacting them again.
