Severe Disability premium back payment taken off me....

Hello...I received my pip about 5 weeks ago and was sent a form to fill in for Severe disability premium which I did and returned, I received a letter today telling me what my esa payment would be as I got Sdp. premium added onto my esa payments but there was also a back payment of £1250 which they say I will not get because I am paying back to an overpayment which I pay out of my esa at £130 per week....are they allowed to take that payment away from me even if it is a severe disability premium back payment ?

They also said to contact their office in 5 days if I have not heard anything from them..

Has anyone had this done before....Thankyou

Sorry it should be £120 per month at £30 per week.....

Simple answer is yes...DWP can and will take over payments back from you.

If this leaves you very short of money and struggling then ring and tell them. They might be able to reduce repayments especially if there are young children in the house

Yes, they can take the SD payment of you, even if it is a back payment.

If you're finding it a struggle to pay £30 per week ring them and ask if it can be reduced as you're struggling. x

All I know is that pip are investigating the behaviour of Atos and capita over the wrong decisions that was made and people who was treated unfairly will get a back payment This I leant from a call I made to pip

Huh. They failed me - 0 points - 7 months ago. Still waiting for Tribunal. Wish they'd take a look at mine. Assessor was useless.

Hi, the DWP aren’t very good at giving money out but they’re very good at taking it back if you owe them. At least you won’t have to be paying the £30 per week back for as long All the best!x

Yes they are allowed to do that as that money is above the basic rate.

All backpayments go towards paying off any overpayments first

The rationale is that you have already made it through those weeks without the funds it isn’t essential to give you them, you may also find that the repayments increase now that you have more going in but it means your overpayment will be cleared much sooner.

Your 10 months further down the repayment path than you were, having more money weekly is better than the occasional lump sum.

They can take money back up to the amount of overpayment, if there is still money left out of £1250 you are due it. All the best.

They even take up to a third of your state pension to pay back arrears. An overpayment of DLA was stopped at £11 p/w from esa, when going from esa to pension, arrears are being paid back through pension at third of.

Oh they can and they do even if it is due to their delay in processing things

but when you have to wait for 56 weeks to get pip they won’t backdate the associated benefits and premiums

they can and do take what they are owed asap but very slow to pay out . All of them

I'm not sure but from my I understanding you should be able to agree a price that's comfortable for you to pay back .. maybe not but I have had an over payment once and they took it back at £5 a week xx

On your weekly payments yes but when they owe you back payment it all goes to the over payment first

I'm having money deducted from my pip for over payment as well. You can ring up and get them to take less. What there taking from you weekly is scandalous

On a weekly deduction you can, not on a backdated lump sum, a backdated payment goes to arrears first.
