Back payment for esa ( surpport group ) Help !!!

Hi everyone

I'm just looking for some advise about back payment for ESA , my husband had to give up working 3 1/2 years ago because of spinal problems, and they put him on the benefits for 365 days and then said that he couldn't have any more benefits because of savings ,we have since Filled a few more forms in and been refused benefits for 2 1/2 years , i filled one in back in November 2013 for him received a letter the other day saying that he's been put in the support group without a medical, it didn't say how long he'd been put into the support group for, so he had to ring them up to ask them ,he has been put in a support group for three years at last ,when my husband spoke to and adviser at the benifits office about his benefit being back dated to when the claim form went in he couldn't answer The question my husband was asking him , he said that my husband was better off on the benefit now than what i he was before, ( well we know that ) so I was wondering if anybody had been in the same situation and if you could give me some advice on this matter please , should he have back payment or not ? we would be very grateful for any advice . Hi Tinkabel. Could you jsut answer a query. When your husband originally went on ESA 3 1/2 years back which group was he put in, was it the Work related or Support group?

He was in the work related group they only payed him for the 365 days .

I've been on the gov.uk website for you and this is what it states:-

You’ll normally get the assessment rate for 13 weeks after your claim. This will be:

up to £57.35 a week if you’re aged under 25

up to £72.40 a week if you’re aged 25 or over

After that, if you’re entitled to ESA, you’ll be placed in 1 of 2 groups and will receive:

up to £101.15 a week if you’re in the work-related activity group

up to £108.15 a week if you’re in the support group

If the assessment takes longer than 13 weeks your benefit will be backdated to the 14th week of the claim.

Hi Tinkabel When i won my esa support group i got back pay from when they stoped my money but i had to go to a tribual and was put in work related appealed again and was put over to support group so good luck with yours xx

Thanks for that fibro10 , I just hope that we don't have to appeal can't take anymore of this esa stuff it's not fair that sick people have to go through all this , as if people ain't stressed enough with there illnesses , will let you know how we get on , thanks again xx
