Hi there, i got PIP without a problem but i had this difficulty with DLA and after 18 months won at tribunal. I would think that by now you have identified at least one thing that you believe entitles you to claim and identified at least one thing on which they state you fail. You need to look at where those differences are and if you can provide evidence that you feel hasnt been considered that confirms your position. But i recently read for example a post that a PIP application had been denied, but the applicant had stated they could walk more than the stated 50 metres without a problem, but struggled after that. Unfortunately stating that in your opinion the rules are wrong will not help, you are being awarded or declined based on the current described criteria and argueing that the criteria is wrong may be a valid point but wont change the award. I really hope you get this resolved soon.

I think I would seek the help of the Citizens Advice and your local Welfare Benefits Officer or Disability Advocate in your area.
You do not have to pay for their services and one of these can accompany you to your tribunal if you give them enough notice.

Hi i was in receipt of DLA and now get PIP no problem. You are assessed on the capabilities you have on the day of assessment. If yku are having a good day you need to try and get them to think its a bad day. You have to be careful what you say and do as they watch your every move. The assessor said i had good grip just because i could pick up a tissue
Hi I get esa due to my severe depression and anxiety I had a home visit for my assessment and I was ill with a chest infection on that day so didn't do the activities she wanted to do i had my letter back and was refused so I rang about the mandatory reconsideration and still refused but since I put my claim in my legs have got worse I'm seeing my doctor on Wednesday so going to see him about them .
