Yes Pip i have. Got turned down on the care part again. They have not taken into account cognative problems. Right now hubby is printing out the form to apply to a tribunal.
My GP has done a mental health test and is satisfied that there is a problem. I am now waiting to see a specialist and hopefully a helpful report off them. I can then send it to them as new evidence.
Just cannot believe how they can turn you down when even the drs and atos assessor agreed you should have it , how long did they take to reply from the date you appealed X
Oh turning me down was easy, I forgot to provide written evidence.
My Gp is reluctant to provide evidence without a specialists report. He rightly pointed out that he does not know enough about how it affects me and does not want to give me a letter that may make things worse for me.
So now i fill in the form and ask them to wait until i contact them before starting proceedings.
You know something we should be very good at completing paper mazes after going though this.
Hi yes I know it's like a total maze , I wrote in a six page letter how it effects me my dr will do a letter maybe I should get him to forward one the wait is draining it's been going on a year now X
So sorry that you haven't got the results you hoped for. I know from my husband's experience with ESA that anyone with mental health conditions unless they are extremely severe has great difficulties proving their case. We went to tribunal which took nearly a year and they wanted to have much more medical information and requested the whole of my husband's file for the previous two years that he had been ill and then it took nearly a year to get to tribunal again but we won. Unfortunately, victory was short lived as he was on contribution based and they bought he retrospective rule so a few months later the benefit ceased. He hasn't tried for PIP but has taken his private pensions early as I think that long wait and all the stress involved for both of us made him reluctant to go through the maze as Mayrose rightly calls it again.
Do ask for a copy of the full report and go over it with a fine toothcomb as we found inconsistencies and also the nurse had recorded his medication etc incorrectly even though he had given her his green and white prescription form as evidence. I think the tribunal from his doctor's and specialists notes could see he had made every effort to work ad that the poor recording on the evaluation form had showed that the nurse was quite incompetent so the decision swung his way.
I asked today for my physio to print off report on my condition for use when I have to apply for PIP early next year and he said he was unfortunately not allowed to give me it and I would have to apply through the main hospital and go up the paper route to get access to my own records. I think they just want to put as many obstacles in our path as they can so we will give in.
Thank you yes the stress of it is overwhelming but I won't give up with out a fight I've just started using morphine patches and having a hard time on them , just would like some support but never mind all we can do is live in hope Xx
I am so sorry to read that you did not get what you were entitled too, and I want to wish you all the best of luck if you decide to appeal this decision?
