My Doc has just said that their is no way I will pass ANY fit for work medical and has written to them stressing that point !!

Obviously I am pleased that I should not have to9 go through that and all the stress and anxiety involved.....Just a thought though....What will they do next?

Atos nurses have a habit of ignoring doctors letters, if you can pick up a pen or an empty cardboard box, they declare you fit for work.

If you have a pulse you are fit for work, according to Atos. I hate to burst your bubble but they don't always take much notice of letters from medics, they think they know better than your GP or specialist. It might be they will call you in for an assessment anyway I'm afraid.

I hate to tell you this but my doc did that too. Now after my 365 days in the wrag my benefit has stopped and my hubby who was due to retire last month is having to work on :( I am feeling like a real burden to him even though he keeps telling me not to as it isn't my fault. I hope it works for you hun but please don't get over confident. soft hugs xx

Well he has told me not to go and he will write to them.I suffered a brain heammorage,suffer from ataxia,fibromyalgia,severe anxiety and depression.....What do you think will happen when they get the letter in view of my conditions and I don't go to the medical.Will they just give me another appointment or take into account my doc highlighting in any event I am not fit to attend any medical.Let me know what you think,thanks

I am afraid that if you fail to turn up they will declare you as a no show and fit for work. What you are legally entitled to is to have your medical recorded. There is a letter and points of law on the benefits and work website. I think this site can give it to you, that says you have the right. Never trust Atos to record what you say honestly. They are scum and will cheat in order to deny you your benefit. Try and see if your local MP will write a letter for you. Or get your doctor to write to the MP.

The best solution is a compromise and ask for a home visit ... They do happen I know a few members who have been seen at home ... But I don't know the outcome ....

But if they take any notice of your gps letter then that is probably what they will do...

If you do not show up it will go against you, Atos decide if you are required for a medical, not your GP. All he or she can do is make an appeal or suggestion, it is not legally binding.

As Grumpy says a home visit would be better, again Atos make the decision whether or not to let you have one although they may well contact your GP to see if one is necessary in your case. I hope it goes well for you.

Do not make the mistake of thinking you are protected by a doctors letter, if Atos order you to attend one of their sham medicals and you do not show up, they will stop your ESA.

I'm absolutely disgusted by what I've read here! How dare ATOS think they are better than GPs at deciding whether a person is fit for work or not?!? We all know they're not qualified doctors, but these are people's lives they are messing with. Do they not have a conscience? How do they sleep at night? I'm very rarely lost for words, but in this instance I am!! Well, nothing that I can put into print anyway!! XX

can I just say philmeister , that your doctor sounds like a good un :)

ask him for a copy of that letter for your file and copy it, make sure you send it with any claims or explaining that you cannot attend medicals or app'ts.

don't just not attend, send letters and call too.
