How long does GP surgery have to supply records

I handed in a subject access request to GP surgery on 29th August. Heard nothing, think maybe they are being deliberately obstructive .

Went in on Saturday for flue jab, the techy man, supposedly deals with all computer queries was there. He asked if I have had success adding daughter to MY GP app as dependant, I said your joking. Then I told him I had requested any and all records via a SAR on 29th August and haven't received the requested information, he said I'll chase that up Monday (9th) have heard nothing. Are they now beyond the suggested timescale.

Hello,

It’s my understanding that they have 1 month. However I understand that should the request be more complex they can have an additional 2 months to respond.

If they are being difficult, then write again with a letter before action and tell them you will report to the Information Commissioners Office (ICO) if they don't fulfil their legal duties to provide your data. If they don't act, then report them.

I suggest spending a bit of time reading the ICO website - it's not the best organised but the information and specific guidance is all there and it's in your interest to understand it if you are needing to make the SAR and possibly a complaint.

How long does an organisation have to respond?

An organisation normally has to respond to your request within one month.

If you have made a number of requests or your request is complex, they may need extra time to consider your request and they can take up to an extra two months to respond.

If they are going to do this, they should let you know within one month that they need more time and why.

My surgery states one month if all of your records are computerized. I think you need to chase up again. Good Luck

Hi Polo22

I made a SAR myself some years ago and had no problems. I think the general guideline is to get a response within 30 days after any due payment - not all practices charge, my own cost me £30 several years ago and consisted of photocopies of both old manual notes and newer electronic versions. I suggested an electronic copy, but they said they could only do manual photocopying! Hopefully this link may provide abit more information for you.
