Hiya Jimbo64. Before you can go to Appeal you need to request Mandatory Reconsideration (you'll find the info how to do this within your decision letter). You will have to act quickly because you only have a month from the date on your decision letter to do so, supplementary details here (info is for England so if you're in N Ireland, Scotland or Wales you'll have to select your country) citizensadvice.org.uk/benef...
If you have enough time to do so I would recommend you request a copy of the report the Assessor submitted to the DWP, that way you can check any discrepancies & use them to support your MR.
I wonder, do you think it's because you've had two knee replacements the Assessor considered it an improvement & therefore the Decision Maker reduced your Mobility component from enhanced to standard? Thinking because you've new knees you should be able to walk further? Quite why it wasn't taken into account you need aids to help walking I'm unsure unless you didn't state so on your renewal form or at the assessment.
I hope your MR is successful & you don't need to go to appeal, or indeed lose your car.
Hi nomoreheel thanks for that I will call them tomorrow
Hi, the person who did my husbands assessment told us they change the goalposts every year, my husband also lost his enhancement despite getting slowly worse from three years ago. I also know two other people that have had this cut, one appealed and still it was a no. My husband couldn’t cope with an appeal this time, it’s absolutely shocking the way they are treating us. I wish you good luck if you appeal x
Hi Lizard28 thanks for your response I am appealing it
I hope you get somewhere when you appeal Jimbo. What they are doing is disgusting. I was on the enhanced rate for mobility on DLA and at that time, I was still able to walk a bit and get on and off buses and carry a bag etc. Now, I can only walk about 20 yards without being in severe discomfort, can't even contemplate getting on and off a bus, even have trouble getting in and out of our car and can't even carry my handbag, yet I have have this taken away from me on PIP.
I am now on the low rate of mobility. I asked for mandatory reconsideration and got nowhere and didn't with an appeal either. All they want to do is to take away any money that we are entitled to.
Hi holly-willow thanks for your reply I logged an appeal the morning
i appealed and won just got to be done
Hi Katrina 1961 I am appealing it I called them today but thanks it’s nice to see someone has beaten them but thanks for your support from Jimbo
Good luck with that!!! I was born with Spina Bifida and also have RA and Asthma, I was on DLA indefinite from a young age for both care and mobility but when it came to my pip assessment apparently I was miraculously well and my car and everything was taken away!!! I did a mandatory reconsideration and still no luck!!! I had medical evidence from the day of my birth to present day nearly 1000 pages of medical evidence and apparently it’s not good enough! I gave up! The whole system is a total joke, it’s based far too much on mental health now which makes a mockery of what the bloody benefit was bought in for in the first place. In no way shape or form am I saying mental health should miss out on it but I think they need 2 separate benefits for physical disabilities and one for mental disabilities! Hope you get some luck!
Hi oKerrio I’m very sorry to hear that it must be hard for you and your family thanks for your reply I hope you get your pip again keep trying never give up
