After 14 long months, and a rescheduled tribunal, I have had the DWP decision to take away my benefits when I switched from DLA to PIP, overturned.
Not only was the benefit reinstated, but the court awarded me extra help.
I know it's hard, but please fight for what you're entitled to. We didn't ask to have lupus. It's not our fault.

Great news so pleased for you, but really sad that people are put through this. Result is great but the stress caused is not acceptable , some people can’t fight the fight, or indeed should have to, it’s another system that fails people. Well done though 👍🙌🏻 Glad you’re getting the help 👍🤗
I think I'm quite resilient, but even I found the stress a bit much.

Am I missing something here? 🤷🏼♀️ I was diagnosed with SLE almost 9 years ago and have Raynauds, angina, atrophying kidney and suffer with anxiety and depression, all of which have prevented me from working for the last 16 years. I was awarded a reduced pension from teaching due to ill health but I have never claimed anything else as I assumed I wouldn’t qualify and look forward to receiving my state pension at long last when I turn 66 in July. But if I am entitled to a benefit I’d appreciate knowing about it. Any ideas?

You are definitely entitled to PIP it is not means tested. You may also be entitled to Pension Credit Guarantee , depending on how much pension you do get as it is based on income. That would entitle you to free dental treatment, eye tests etc if you do not already get it? The Turn2us site have a benefits calculator to inform what benefits you are entitled to. We only found out about Pension Credit Guarantee when we used it. Good luck xxx

You are so welcome lovely. I had to fight hard to get DLA despite all the medical reports I had at the time. Then they sent an assessor to my home who decided I was faking illness and they not only took it off my but demanded the money they had paid me for two years back, even threatening bailiffs. I went to Tribunal and got it reinstated. When it changed to PIP they put me through two individual face to face assessments one in a centre and one at home. Neither assessor had any idea of my conditions the one at home was a mental health nurse. They lost the first assessment and I had to submit a complaint. All my deeply personal info in the system somewhere?? I had an apology and compensation of £75. It was never about the compensation but the fact that they had treated me with such contempt. It is daunting and demoralising but it helps significantly with things we need to make life more comfortable and bearable. You will also get your car taxed if you get the higher rate of mobility and of course a Blue Badge which is priceless. Xxx

Please do try for PIP. It was a pain, but I persevered and went through mandatory reconsideration and a court tribunal, and won. Don't give in. As long as you're not in receipt of state pension, you should be eligible. You will need to get your application in before you're 66. Even if you are turned down and appeal, they will back date it . You cannot apply for PIP AFTER you are 66, but if you are getting it before that, it will continue.

Hi Spotty-ewe..as I work full time i assumed I was not entitled to any benefit.I applied..they loss my claim later found it..took five months all on all and recieve one component which is around £50.per week.. it was all very stressful..make sure you have your hospital letters..GP letter and describe how you feel on your worse day..I neally didnt bother..more so I was never informed of this benefit..found out about it by chance conversation..If you do try..good luck..have a lovely day

Yes, I have all the paperwork and copies of medical reports etc used for my application for early retirement from teaching due to ill-health. I was thinking these might be useful. My Union helped me then but I only recently dropped my membership so I wouldn’t get their help now. I was then a carer for my Mum for 2 years until she passed away in 2006. Thanks again tjo 🤗😘💐

Can’t put a new claim in for PIP if your on state pension , welfare rights put me on course one year before I retired there is another benefit you can claim x

I am so glad you got the DWP decision overturned. Like you, I had to fight them to have mine reinstated. I agree, we are entitled to certain benefits, it can be stressful sorting these matters out, but pleased find the strength to fight!
Wonderful news. I am delighted for you. I know how hard it is to fight and how difficult the DWP make it for you. I had to go to Tribunal five years ago when an assessor decided that I was healthy based on looking at me, disregarding all the medical evidence. The DWP quickly rang and wrote insisting that I repay all the benefits I had claimed “ fraudulently ”. So I had to have two Tribunals. It made me so ill with the stress. The first Tribunal overturned the DWP decision and this meant I did not have to go through the second,. The relief is immense. Hopefully they have awarded it to you for a lengthy period? Well done for beating the bullies xx
