After reading about the horror of dla medicals atos assessments etc ... And now the introduction of PIP I saw this and wondered if this is where it's all going to end........ One quick test to decide who gets benefits or not....

When I had my medical at home by Atos the doctor told me that I was not fit for work and if I got refused to appeal and I would win. I got refused and was put in a work group so am now appealing but have heard nothing for over 6 weeks. What I don't understand is.....If my doctor and their doctor say I am not fit for work who has decided that I am, against medical opinions?

I just don't get any of this, and am now too tired to fight x

Have you seen your ESA 85 assessment report? If you have, look through it carefully and see if the Decision Maker has over-ruled the Doc or if the Doc has told you one thing and done another (neither scenario would surprise me!).

If you haven't seen your ESA 85 assessment report you should contact the DWP and ask for a copy.

To get an idea about the accuracy of the Work Capability Assessment (WCA) you may find this of interest and why it is important that everyone gets a copy of their ESA85 and goes through it with a fine tooth comb!

No I haven't seen my ESA 85 assessment report but have just called and asked for it. I was told that this would be sent out before an appeal and that I should wait. I have insisted that it be sent now but am not hopeful that this will be done but can only wait and see.

Just make a nuisance of yourself & phone every other day or so until you get it!

Hi

I tried calling for my ESA85A. And got fobbed off, I honestly don't think the DWP have a clue what they are doing. I was told to phone Atos, the DWP have to have it to make a decision based on the recommendations of Atos, I ask you? Anyway I ended up writing and sending it recorded delivery. You may well end up paying more to keep phoning them and will lose sanity points if nothing else.

A week later I got it through the post. I think the lesson is to put it in writing as it is much harder to ignore and always get proof of postage. I wonder what it is they don't want us to see.

I also requested this a few weeks ago, but also no show, so Ive sent a letter by recorded delivery requesting it

Unfortunately from what I have read it seems with few exceptions most people automatically get turned down ... Why I have no idea... Then they win on appeal.... Trouble is appeals seem to take so long to be heard.... Please don't give in .... Our new member has just posted about going through much the same thing ... If you keep an eye on that thread I am hoping people will answer with some advice ...

They do seem to turn most people down! One woman in Scotland is paralysed, but has the use of one arm, so she was put in the WRAG group - I ask you!

i had an assessment in november by a nurse and because i could take a packet of tablets out my bag was one thing that decided i was fit for work i cant pick up a carton of milk or go shopping as i cant carry the bags so i think a 30min assessment is a load of rubbish as the nurse does not see what i go through on a daily or weekly basis ATOS is a joke and i am now facing a tribunal which is putting my stress levels through the roof.

Yes, it is a good old fashioned witch hunt, the only thing that is different about it is, the clothes we wear. IDS is a modern day witch finder general. :)

Will IDS do the decent thing and offer to live on the £53.00 a week challenge. Apparently a petition was delivered to his office to that effect following the infamous radio phone in of a couple of weeks ago. Will he have the courage of his convictions I wonder? Answers on a postcard please.

They get turned down then win so atos make more money, well that's what I think happens , but I may be wrong

Hi I`m suffering with P.T.S.D, which I`m under a Psychologist for and it had taken me 10 yrs to get this kind of help. Which in the time waiting for help I have now been diagnosed with Fibromyalgia, but some of my Symptoms relate to Rheumatoid Arthritis.as recently suggested by a Registra but blood test prove negative. I don`t get no help with Fibro also no treatment,.I find it very difficult to get through the days everyday. I have been on suicide watch and have had all adaptions done in my home to try and make it easier for me to live. I`m waiting on my grant for stair lift and wet room. I have also been allowed to have outside adaption like a ramp as I have been given an electric wheel chair to help me get around in doors and out, I have find everything difficult to do, I also have a very low concentration spam due to Fog brain. I also forget things that peeps have told me due to this. I also have bad panic attacks and anxiety attacks I find all D.W.P medicals cause more stress too me and is very stressful, Its very hard to explain Fibro when you look alright but really your at your wits end through tiredness and constant pain. Maybe these kind of peeps need to go on a medical when they are not well and see for them selves how they can relate to us all.

Hi very grumpy, Last year I just got rewarded my E.S.A,after a long look at it again and waiting to see if it was going to go to court. Well this is what happened on my medical. My appointment was at 9.30 in the morning, and had to get up at 4am to start to get ready, and have breakfast along with medication i take for P.T.S.D. Anyways finally gets there, name was called, so in I went with great difficulty in walking, along with all other problems. As I entered the room the woman who was given me the medical looked like she just been slapped across the chops with a fish, she looked like she was having a bad day, well as I entered the room she said sit down, straight away I thought to my self how rude at least an hello would be a good start, well as the medical proceeded things got worse for me, bearing in mind it was a Friday she probably thinking about the weekend shopping etc. Anyways she tells me to get on the bed which I had great difficulty in doing as I also have Facet Joint Arthritis and two bulging disks, she was so unhelpful, then she decides to hit me knees with black stick thing to check me reflexes well it did hurt and iI told her so, but she comes back with that should n`t of hurt well i wanted to cry as I also suffer with knee problems where I have had 3 operations on left knee and one operation on my right knee. Well after the Medical I waited for the results Much to my expectation she had refused it, so I set out to appeal against her, telling D.W.P that the lady I saw was having a bad day, and I was treated badly and how In all the 4 other medicals I had Previously had never been treated the way she had treated me. I threw every piece of evidence I had at D.W.P. and based on the Previous evidence and the new evidence I had provided I finally got awarded. But I keep asking the same question why is it they always have an independant doctor to make there decisions for them but yet they always ask and go by your own GP and Consultants what is the point in this ?

I'm in the WRAG and didn't realise I could appeal!! Will this go against me when I'm next assessed? Worried!! XX

When did you get put in the WRAG?, You have 30 days from the date of the letter to appeal to be put in the support group. I know this as I sent in my appeal a few weeks ago, and I have also now requested all the information they used to be me into the WRAG group to be sent out to me incase the appeal goes to tribunal. I'm not qualified so Im not sure if it would be used against you at next assessment. It's my view that they are putting most people into WRAG to see if they will appeal.
