Finishing work and finding a benefit

Hi all, I have just had a phone call from my employer and we have come to a decision that it is in my best interests that I finish working for them as my fibro has made it impossiblefor me to work anymore. I already applied for PIP but they said I wasn't eligible(don't know where they got that from),I am appealing about it. Can anyone help me in how I can claim a benefit and which as I have never had to do this before. Its really worrying me as Christmas is a matter of weeks away and my bills still need to be paid. Hope someone out there can help me x

Get immediate advice from Remploy or CAB. this sounds like a case for them to advise on the legality of your termination of employment. If you leave work you may not be able to claim some benefits for quite some time.

What a very difficult time for you day to day anyway but to then layer this on top is traumatic. Please do check with the experts suggested by fellow well wishers in previous posts. One thing, are you in a Union at work? If so, have they represented you through your difficult times at work, attended meetings with you etc? does the Union provide access to free legal advice? I ask because it’s worth double checking you have been supported /treated fairly by your employer. Has your Employer acted appropriately/exercised their duty of care /not discriminated against you I.e not fully complied with ACAS /Equality Act 2010? Remember, it’s not always consciously happened or intended by an Employer but nevertheless it does happen. Have a quick look at any Employer Sickness Absence/Capability policies & check Employer has followed each stage of their Policy. Did you discuss a move to another more suitable role in your Company with your Employer or request any reasonable adjustments that would have helped you manage your job such as going part-time, more breaks, altering your start/finish time for example. Have you had a chronic illness that you have managed to work with & then something else has happened I.e (peri-Menopausal or Tinnitus etc? It’s not a witch-hunt against your Employer, all this is there to protect you as an Employee. I know you maybe running on empty for it to have come to this point but if you start process for applying for benefits then either way it’s going to need time & a strong constitution! Hello, so you where found not to be eligible for PIP. One reason you are not eligible is you don’t meet the criteria for claiming PIP in relation to the PIP descriptors. PIP is not awarded on a disability or diagnosis but on upon your inability to cope and manage the PIP descriptors safely and repeatedly in a timely manner. Have you done a self test of the PIP assessment on the Benefits and Works site I did one the other day and scored 21 for daily living but when I had my assessment I was awarded 8 and after my MR I was then awarded 14 . So PIP may sound easy it’s still has to be awarded correctly.

They lied in a big way. They said I was walking to work everyday and I have been signed of since January so how could I be and I would live to be able to walk that distance. Also they said I was dressing myself everyday and showering on my own every day and that was a lie as I heed help to dress and undress and help and supervision while I'm in the shower, my partner showers me washes my hair and stays with me the whole time as I need help in and out.

You now need to do a mandatory reconsideration of your PIP award. Focus on the descriptors where you think and believe you should have been awarded point or more points giving supporting information and evidence. Give real time situations of what has or does happen when you try or attempt the PIP descriptors that your contesting. Do not mention that the HP lied about thing at your assessment as it won’t do you any favours. You can say the HP misunderstood what I was saying or the HP was confused about my answers reference questions XXX.

Morning Ajay, there is still a lot of information on social media saying you can or could get X amount of£s for this or that and very little information on how to claim or what the descriptors criteria are to get awarded. Nice and sunny here but cold forcast for the coming week.

Are they medically retiring you, or suggesting you resign?

DON'T Resign, as it blocks you from Unemployment Benefit for several months.

Make them sack you.

I did this and it took months to get sorted,let them finish you ,as it takes six weeks before I could claim,as they then had to contact my employer etc and then getting sick notes from my doctor for weeks on end,it's all sorted now but it was a nightmare at the time,hope you get sorted soon

You need professional advice regarding this if you have paid in to a pension you may be able to retire on health grounds. You need to be very careful before you decide what means tested to apply for I would seek urgent help from a money advisor good luck
