Hi contact either your local Citizens Advice Bureau or Local Authority Money Matters advice service. Money Matters helped me.
Do not loose heart. After my mandatory reconsideration I went from 8 to 28 points. My own report was a nonsense. It is a horrible cruel system but most win in the end. You now have help and support which makes a huge difference.
FMA UK's benefits helpline can send you guidelines to help you appeal your decision. 0300 999 0055 (Mon, Wed, Fri 10.00-12.00) or email benefits.advice@fmauk.org
Hello Freddie,
Don't feel like a fraud; it's part of the psychological warfare the DWP and CAPITA, IAS and the other assessing companies try to knock us back with. Its an insidious practice, designed to frighten and make us give up perfectly valid claims, and particularly targets the new claimants, and those with doubts as to their eligibility.
Get a copy of your assessment report ASAP, then you can be forearmed against them. It is more than likely they will knock you back, don't give up, it's what they want. Apply for Mandatory Reconsideration if they do, and if they still won't budge, tell then you will go to Appeal. More than 70% of Appeals are won by the claimant, and If the DWP feel they are likely to lose, they will phone you with an offer prior to Appeal. No matter how good it might sound, accepting that is a no-no, as it will be less than you deserve, and it is better to go to Appeal. Also, accepting the phone offer is a bad thing, because there will be no 'paper trail', should there be a subsequent problem.
Please make sure you keep copies of all correspondence, as DWP have been known to 'lose' paperwork; also anything you send to them send by Special Delivery. I know it is more expensive, but it is a Guarantee of Delivery, where as Recorded signed for is not.
Hope this helps,
Cheers, Midori
