I got turned down for the motability but got standard for other part . I really feel like I should’ve got the mobility part as really struggling to walk I’m like a 80 yr old woman 👵🏻
If you think the Mobility award is incorrect, you need to request a Mandatory Reconsideration and if that goes against you as 80% do, appeal. 3 out of every 4 appeals are successful.
Begin by requesting a copy of the Assessor's report and don't just rely on the DWP decision letter that quoted from it. Go through the report carefully looking for errors, omissions and inaccuracies.
Has all of the evidence you submitted been listed? Is the list correct? If you are a DLA transfer, has the DLA evidence been listed? If not you can assume it was not considered when it should have been. If DLA evidence is not listed, that is negligent of the assessor.
The report then gives a History. Is it accurate? If not tell them what's wrong. The next section is medication. Again, is the list accurate? Have any side-effects you told them about been taken account of? Has any drug been listed against the wrong condition?
The next section is Social and Occupational History. Is it correct? Are things written down that were not discussed or that are completely wrong? The Functional History then follows. For each area where it is possible to score points, are the statements made in the report accurate? Has anything been left out or ignored? Did you supply evidence that is at variance with what the assessor has written? If so, point it out as an inconsistency.
The next section is the assessor's own Observations. They watch you from the moment they arrive until they leave. Often this is used as the crux of the decision. If you walked OK inside the house for a few metres, they say you are OK at walking much further.
The next section deals with points awarded and why. From the DWP decision letter you will be able to tell what they relied upon. If it contains errors, omissions or inaccuracies, list them. If you can back up what you say with evidence from Doctor's or Hospital letters, do so. You are entitled to a copy of all of your hospital and GP records, but there is a charge for them.
Someone I know, provided 15 letters from friends and relatives saying she could not walk 20 metres, describing the help they gave her and offering to be contacted by DWP if they needed more information. She got Enhanced Rate on Mandatory Reconsideration.
