Got my letter after all they mush have found it hooray, well not.
I got a phone call on Monday from the person who made the decision of taking my car from me. That my copy of my letter of compliant about my assessment had just landed on her desk. So the decision was made before she got a copy of letter to ATOS?
Well here goes I got standered motability which gives me a bit of money but still takes my car and standered pip and as she explained to me I can plan a journey so that's why I lost it. I told her while I can plan a journey I couldn't carry one out to an unfamiliar place due to several reasons.
I told her that the assessor only asked me if I could plan one and that I had to stop her and explain everything to her to the point she asked me were I drive to and I just said local. But she has not even mentioned this but said she could see it on my complaint letter to ATSO and that she was sorry that the decision had already been made, but to ask for a reconsideration.
She also said that she is going to be very interested in there reply.
So it's not as bad as we first thought but still not happy.
Will soldier on. We bought a car at the weekend an old one thanks to my mother in law till we get our grant through.
Will up date as I hear anything .

Ho I got full ten point for mobilisation and none for the other go on pip benifits and work.
You will see there's only two questions for that. But mine should have been cannot make a journey to a place unfamiliar that would have given me another 10 points . That way I would have kept my car, hum we will see we are part way through writing my appeal

hi their well done hope all goes well i know what its like some years ago i went though the same thing but when the doctor who was suppose to by an expert said how much pain does it give you when i asked him if i could it him with my walking stick he ask why i said then you will now how it feels got mine over turned then and than hope all goes o.k kind regards Alan
Thanks Alan yes I am going to fight it, the funny thing is the lady who rung me said she had made the decision before seeing my letter of complaint to ATOS and it had only just landed on her desk told me she is going to be very interested in there excuses and to ask for a reconsideration.

It was only a copy of the letter which I had sent to ATOS to complain about how I was treated at my assessment. I sent a copy to ATOS and DWP hoping they would get it before any decision was made. Nothing to do with the actual decision .
We are in the middle of writing a letter back asking for them to look at it again.
The main one being planing a journey and carrying out to a unfamiliar place which is what I can not do.
Yes I can drive my car locally and to some places I know. But aren't we supposed to that's why we get a car I am totally confused with this one.
It seams to me that if you can't plan a journey and know where your going then you can have a car no problem!.
Taking this one especially with my MP really doesn't make sense at all.
Don't really think that they have read the questionaire write be cause on several occasions she refers to I have told them I have trouble reading for instance.
But if you look at my form I have clearly tick NO but it say if your condition varies please tell them.
So I have told them why I have given up reading books and mags because it cause to much pain. Didn't expect any points for it as I have clearly tick the no box when it ask you do you need help with reading and understanding.
Just stupid.
The assessor had put that I never mentioned any problems at the assessment. When I clearly did explain to her why don't do it. She even asked me do I read magazines I told her know And why don't expect anything for it.
Any way Ken hope this gives you a clearer picture.
It really is poor treatment, if you tick a box saying one thing then how on earth can they say otherwise? Good luck with asking them to look at it again. I genuinely and sincerely hope that you are successful.
Hi Ken This has happened on 3 occasions so far I have pointed out to them and the assessor has stated on her report that I did not make ref to it on the form or at the assessment.
So I have pined a copy of it to the relevant paper work suggesting they both haven't read it.
my son is home for a wedding next week so he's helping us go throught it step by step.He is great on setting things out and paring things up has part of his job is lecturing, and teaching when not protecting boats from pirates yes don't ask it's complicated. He's all over the world.
Hopefully it will be done before he has to jet off again.
There is a lot of contradictions. But luckily I have all paper work I always keep two copies.
