I have been placed in the wrag for ESA, I appealed and it has now gone to the courts. I am very scared about this.

One reason was no supporting evidence so have since got a letter from my doctor and specialist. Stating I have rheumatoid, fybro,asthma and is waiting to see a neurologist! I also had no medical for them to support there evidence!!!!!!. Do I need to go to the court or just send this new evidence. Having a tough time at the moment as my dad has just died and can't face it! Thank you

Hi Really sorry about your Dad. If you haven't done so already send them (I'm assuming it tribunal) a print out of your medical notes, you can request this in writing from your GP's surgery it cost about £10.

I think if at all possible you should go to the tribunal,get some one to go with you, as it's better if they see you and can ask you any question there and then about your problems, I have been to 2 so far and I was very anxious about it all but I won both.

Debbie, I am so sorry to hear about your Dad. You have my deepest sympathies.

the last thing you need now is all this esa stuff.

make lots of copies of these supporting letters and keep them safe.

put your name and national insurance number on the top of each page and send a copy of each letter in.

also put in a brief covering letter stating:-

"supporting information for my claim. please take these letters into consideration."

put your nat ins no on this letter too. send it recorded delivery.

Send a copy of the evidence to the address for appeal as soon as possible and then call in a week or so to confirm they have it if not heard. They have to review it but it has to be with regards to the time that you made the claim?

Hi, so sorry for your loss, and with all this too, I was told a few years ago to go to court about my ESA , I went , didn't want to but I went anyway , was told pull myself together , turned down , then re appealed. And went back spoke to a different doc there and was put in the correct group and a few days later got the money back dated from the beginning , don't give up never , as if you do they will just think you are making it all up , keep a diary of complaints you have and a symptom diary too, speak to ESA people or if more help go c. A.b . Hope all goes good for you . X

I'm in the WRAG too, but I feel I should be in the Support group. My problem is I don't have any written documentation supporting my claim. I feel sure this would go against me in any tribunal.....XX

Hi everyone... So sorry about ur dad xxxx. Can I just say.. I went through lots of tribunals and eventually won.... Please make out ur ill health and struggles are everyday (which mine is).. Cause if u say.. Sometimes or maybe can do it, it does not work... Please keep chin up.. If u need any help please pm me xx

It's usually reckoned that you stand a far greater chance of winning if you attend in person and even greater chance if you have support from someone like the CAB or another advocate. Best of luck Xx

Thank you to everybody for your kind words, trying to sort this out and arrange a funeral at the same time is very difficult!! I did ring to see if I could change tribunal date but was told had to send various forms and proof he had died!! Honestly all this stress i s making everything flare up and told to rest by my doctor as have a very fast heartbeat!! They should realise at these appeals how much stress it causes, and also had doctors letter saying I can"t work!!!!!!!!!!

Please may I offer my sincerest condolences on the sad loss of your father.

I don't have much to add to the great advice you've already been given above.

I believe you have the right to have your Tribunal recorded. Hopefully someone will correct me if I'm wrong???

This may delay your Tribunal long enough to concentrate on arrangements you have to make.

I would just like to say thank you to all for your kind words. It was the tribunal today and had a phone call before it to say they had looked at my case again and I have now been placed in the support group now. What a Hugh relief this is. If you are claiming keep fighting!
