Hi Emma-Jane, on what grounds does he want to evict you? x

My bank account messed up so they transferred the rent money into the wrong account.

So we now owe the landlord £4000 and my bank will not help me.

you do owe the landlord he has every right to be paid regardless where the money went astray or how it went astray.

If you made the error yourself by typing in or writing down the wrong account number then it is not for the bank to sort out. You would need to write a letter to the account holder who has suddenly had a windfall, and ask the bank to pass it on in the hopes that the person who now has your money can be persuaded to pay you back.

But they don't have to and may already have spent it.

here's a good article explaining this issue - thisismoney.co.uk/money/sav...

If the error was actually made by a bank teller not you, then the bank is at fault and they will need to credit your account and try and recoup the money from the account holder who has received the windfall. you should contact the banks customer services and then failing that the financial ombudsman or perhaps one of the money advice columns in a newspaper - because bad publicity or the threat of it can move the banks to act a bit faster.

If it was your own error- the banks have no liability to fix your mistake - nor do they have to pass on any letter you write to the account holder who now has your money. they may do that as a gesture of goodwill, but they are not obliged to and they cannot force the account holder to pay you back.

In those cases you need to consider your options. the landlord still needs paying somehow. So do you apply for a loan in which case you will probably need something to guarantee the loan. Or a relative of friend or even your employer to act as a guarantor, and then you pay them back as quickly as you are able to.

Or do you cut your losses, move back with parents for a while and save up to start again. you would still have to pay the landlord - but would be saving on rent and bills each month by house sharing with others be they family or friends.

have you planned back up emergency accommodation with either of your respective parents or siblings or other friends or colleagues, if they can put you up in the event your landlord does evict you.

have you looked into protecting your possessions - getting valuables put in to a local storage centre.

The are not that expensive and some have 24 hr access.

When I put all my stuff in storage it was £15 a week when i lost my house and I moved back in with my parents.

My stuff was in storage nearly 2 years, but i could come and go as and when i needed to pickup things i needed.

I was forced to downsize from a 3bedroom house to a small room living on a sofa, but i did manage to keep my little treasures. not exactly valuable things by any means - but the things i loved most. Even my childhood books and toys.

The landlord can take steps to lock you out of the accommodation if your are evicted and your stuff can get locked in, or disposed of or damaged, so do protect your treasures by re-homing them in a safer place, be it storage or at a friends or family members house.

Look about your possessions for things you could sell or pawn to raise money quickly. Paying your landlord in chunks is better than not paying anything at all. Jewellery can always be replaced - even engagement rings.

do you own washing machine and tumble dryer? Both are luxuries and clothes can be washed in the bath and drip dried, or taken to a laundrette or you could borrow the use of a washing machine in a friend or relatives house once a week.

Can you save money by cancelling monthly phone subscriptions, or internet charges? is your home big enough to sublet a room to a student to bring in extra income? If you have lost a huge sum of money then you will have to really tighten your belts to get out of the pickle as quickly as you can by whatever means you can.
