That’s not good. Have you got a copy of the assessors report? If not phone up and ask for it. You can ask for a mandatory reconsideration but I don’t have any experience in how to go about that. Maybe somebody else can advise.
Get an appointment with CItzens Advice Bureau they have people who are very good at dealing with PIP applications and with failed PIP.
Was your assessor qualified to asses your illness. A lady living near me went for PIP, she has severe mental issues that includes difficulty leaving the house, the Assesor was an OT. She went with her husband, who was not allowed to speak, and the main thing she remembers is the person kept saying that she managed to get through the door ok.
CAB are helping her to get it reconsidered.
When i applied for pip, i treated it as my worst possible day. If you tell them your illness is up and down it is so hard to get it
That's exactly what I did. Even going through a flare at the time of my assessment, with my hot water bottle constantly attached to me.
Sorry to hear this..I would put a Mandatory Reconsideration in as soon as possible and get as much supportive evidence that you can, it has to be different to the evidence you supplied for your original application. Good luck!
Did you fill out your form under the guidance of Benefits and Work? They seem to achieve very positive outcomes for people. If not, maybe give it some consideration for your Mandatory Reconsideration or any appeal?
I would appeal , the more you hear about these assessments the more you want to blow your top, this government is an absolute joke xxx
I to was disappointed I only got standard care even though before on dal got both high rate for life I'm reg visually impaired put in mandatory was in successful good luck
Do go for a mandatory assessment - the success rate is high!
I was successful following a mandatory appeal. You call them then you need to put in writing why and use evidence like hospital letters etc.
You have to appeal almost all the DWP decisions these days so am afraid you have to dig in go to the local CAB or welfare advice service and they will take you through it
Dear Ruth
You must request copy of the report and a mandatory reconsideration.
In the mean time do a self referral to you local adult social services for a OH assessment. Get them to come and see you at home, make sure you behave and show them what your worst day is. Once you have that report, send it to DWP. This will really help your case.
Overall, be patient. It takes ages but don’t give up. I went all the way to tribunal (on paper as I didn’t attend) and the Court overturned their decision and I got my PIP and it was backdated.
Good luck.

There is a forum called Fightback4Justice you can join, which has lots of useful threads fightback.boards.net/board/...
I've only just seen this! I'm so sorry Ruth. Definitely call the DWP first thing next week & ask for a copy of the assessor's report, so you can see where the points lay. From there you can determine if it was a fair assessment & where you disagree with the assessor then you can start plans to ask for mandatory reconsideration, if you wish to that is. You only have a month to request this so time is of the essence.
Did you include any additional information from anyone involved with your condition, from your Rheumy, GP, OT etc with your PIP application? If not I would recommend you do, or indeed anything extra to support how things affect you & the difficulties you have daily other than than the supporting letters you sent in originally.
I was suspicious why your assessment was two hours long, but then decided it was maybe him being thorough, just don't understand why you'd be refused but the report should clarify.
If you had any help from CAB completing your form I'd contact them again, see what their take is on it & see if they can help further. Meantime have a look at this link turn2us.org.uk/Benefit-guid...
When I had my home assessment, I was having a flare at the time, feeling like shite, didn't want to talk to anybody, but had no choice. The assessor could see what I was like, & did feel quite sorry for me, even offered to make me a cup of tea.
I'm going to get in-touch with the benefits advisor who helped me fill my form in, to let her know the outcome, also going to get more info from my GP, as just recently been diagnosed with SAD ... GREAT!! Also have an MRI next Saturday on my spine, as having a lot of discomfort & pain.
Will try & get in-touch with the DWP on Monday.
It's so disappointing what we have to go through. May look perfectly healthy on the outside, but, people can't see what's going on, on the inside.
Also how come when I was assessed earlier in the year for the ESA I scored 6 points, as this one, scored 4!
Bloody Unbelievable When My Condition Is Worsening.
Stresses you out, trying to fight a battle.

RIGHT TIME FOR A CUP OF TEA

Right, action time. Contact the DWP first thing Monday morning & request a copy of the assessor's report & then the benefits advisor to advise them of the result & that you've requested a copy of the report. Once you've received this go through it carefully & make a list of inaccuracies & where you think the assessor has misinterpreted (or dare I say lied) how your condition/s affect you. Once this is done then contact the DWP again to let them know you're requesting reconsideration. Gather any further information you think will help your case. Compose a letter telling them why you disagree with the result, including any inaccuracies you found in the report. Keep a copy of everything you send in. Remember you only have a month from the date of the decision letter to send in your reconsideration info.
All the very best & fingers crossed the reconsideration decision will be a positive one.
Totally correct, and yes, do say lied as my first one said I walked from the bus stop to their centre, they couldn't see me from their offices and even if they did see me, then they would have seen me sat down for 30 minutes before I completed the final 100 metres, that was the first comment of the report, so was a total lie, the lies got worse as I read through the report.
My second one was with a midwife, I didn't know I could get pregnant, she walked out after 5 minutes as she wouldn't let the recording continue, ATOS had already been informed audio recording would be taking place,I had more than enough recording by that time to prove she wasn't qualified to report on my condition.
Get the report, read it, ask for mandatory consideration, many of those succeed and if it fails then appeal it to the tribunal as many more succeed there as well.
Hi,
Can I ask how many points did they give you.
When you ask for them to reconsider make sure you have copy and send it recorded or special delivery.
Thankyou everyone for your responses.
Will be on the phone to various bodies on Monday.
I am not going to let this go. x
That’s the spirit!!! Don’t give up, there’s lots of support out there. Good luck and let us know how you get on 😊
I know that feeling too 🌺
Hello everyone- my first post on here (well, reply) but I felt compelled to respond to this.
I went through the same thing and really feel for you Ruth - it is such an unfair and humiliating process, don't even get me started! Good advice from everyone... there are also some 'example'' mandatory reconsideration lettesr/templates online which you can fill in with your own info/adapt to your situation. I found that very useful and used one from 'advice now' as my starting point... The CAB website has very useful advice too.
See exactly what they have said in their decision letter (when you are feeling calmer!) and their explanation and see where you disagree. A lot of the things they said in mine were factually incorrect vs what I had stated in my initial application (I've heard that is quite common), so all of that went in. The key thing is to go through each of the daily living/mobility activities and argue how many points you should have according to their descriptors and versus what you have been awarded at this stage, referring to as much evidence as you can (your original PIP application, hospital/GP/OT/Social Services/carer letters/reports etc. You can also write a diary and submit that- keep the activities that they measure against and the descriptors in mind the whole time).
As others have said it can be useful to get a copy of the assessors report but I left it too late in the day for that so had to just go with what I have mentioned. You should also refer to your original application in my opinion- frankly it feels like you are repeating yourself again and again but hopefully you will be successful this time. If not, go for the tribunal. Keep persevering and try not to lose hope/let it get you down- easier said than done. As one person said to me, channel the anger! Apparently there is a very high rate of successful appeals vs original decision (shows how broken the process/system is).
Best of luck with it!
