Is lupus covered under the disability discrimination act??

So if I am looking to reduce my hours at work due to lupus and in particular stop working Saturdays so I have 2 days off at the weekend I can use the DDA to back me up??

Hi lindsay81 , yes as i was off work for one and half years and when i went back i reduced hours and i am now covered under the DDA, i work for the NHS, i am a nures, they had to make adjustments as i could only do days and no nights and i work three day most of the time early shifts as i find my joints swell up towards the evening, this helped as the manager could not say that she could not arrange these shifts.

Hi Lidsay,

"The definition of ‘disability’ under the Equality Act 2010

In the Act, a person has a disability if:

they have a physical or mental impairment

the impairment has a substantial and long-term adverse effect on their ability to perform normal day-to-day activities

For the purposes of the Act, these words have the following meanings:

'substantial' means more than minor or trivial

'long-term' means that the effect of the impairment has lasted or is likely to last for at least twelve months (there are special rules covering recurring or fluctuating conditions)

'normal day-to-day activities' include everyday things like eating, washing, walking and going shopping

People who have had a disability in the past that meets this definition are also protected by the Act."

Main thing comes down to being a condition that is likely to last for more than 12 months is covered. If you work for the Public Body like the NHS the onus on them relating to the DDA goes further making it a legal requirement to positively promote disability equality so you would be further covered if that helps.

Yes that is true as iwork for the nhs and i am covered under DDA as i was off work for one and half year.

Hi Lindsay, Yes it most definately is, I have had it confirmed in writing by consultant and GP however my experience with work did not end so positively. I gave 23yrs into the pharmaceutical industry but after my latest serious flare which resulted in 6 mths off work, on returning and under DDA and reasonable adjustments, they suddenly had 'issues ' (lots to go into here unless people are interested?!) this ended up in a capability hearing (no, didnt do anything wrong, honestly..!) which ended up in my resignation abd then a tribunal!! Sadly, Ive gone from a 60k a yr salary to zero and not being able to get a job on min wage! Happy days eh? ; )

I work as a paramedic and they're doing exactly the same to me lindsay, with capability, they keep trying to say is it your illness etc. fortunately for me I have a great union rep and I don't take prisoners when they try bullying, they have made no changes to my life quite the opposite, so I know have a sickness review hearing, a occy health meeting with the dr. Nice to know we are supported by our caring bosses in the health sector. At least we have dda protection.

Hi medic1969 - where do you work? It all sounds so horribly familiar, glad you have a good union rep, sadly I didnt, I did seek legal advice and was told my case was foolproof but that ended up costing me 32k ..... Long story! X
