Hi hunni, im sorry but im not on benefits so i cant advise, i just didnt want you to think no one was interested, but in the next hour or so everyone will gradually be coming online and there will be lots of advice, if you ask Libs in admin, she is very knowledgeable in these things and she can send you some sheets about benefits which a lot of my firends on here have found very useful...hope you get it sorted, take care...Charlii xx

Hi, i am going to be in the same position within the next 2 weeks, and i have been told by the benefits agency to appeal to get put into the support group, and while that is going on, which apparently takes forever, i have been told to apply for an income based benefit. Dont think i will get it though as my husband works. I hope you get it sorted out. x

I went through this appeal process,I did win my appeal, But I am really sorry to tell you the appeal process took nearly a year, :( and strangely enough I was awarded DLA weeks later, without even a medical, certainly it was only the lower rate on both components, they gave me the lower rate of care, they said although it is difficult for me through the night, I can manage, this is not quite true, but I don't want to contradict them and rock the boat,I was having nightmares about going for the medical, so I am so relieved that I didn't need to have one, but I definitely think being in the support group bracket, supported me in my DLA application. and they also backdated the money owed since the appeal date, I wish you well in your appeal. So sorry this has happened to you, it must be really upsetting, sorry I don't know enough to advise, but as charlii said ask Libs in admin she gave me some good advice, she is also very supportive and encouraging, I hope things work out for you. (((SOFT WARM HUGS)))

Appeal appeal appeal,, you may get it next time round ,, heard this so many times in here. I rekon sometimes it's who actually assessing you,, lots if luck don't give in x

Hi

Is it because you have exhausted the 365 day rule. I belive that contribution based ESA only lasts for a year and then you need to re-apply or appeal and be put in the support group where the 365 day rule does not apply. Many people are falling foul of this rule I am afraid.

Contact the LSC, they will put you in touch with a solicitor to help you appeal, you have to appeal within 30 days.

Not AFAIK, they will prepare your case, that's all they do.
