Esa tribunal just failed what do I do

Going out of my mind my appeal tribunal has been declined again not had any money in 5 months j owe so much out I'm feeling so like just ending my life today never been so upset

Awe thank you Emma that's so nice of you I really don't no we're to start it's all making my head kill had a constant head ache for few weeks like someone's squeezing it seriously how is someone suppose to no you after a 20 minute appointment it's laughable thank you for your concern x

I am afraid you only have three options if we exclude your appealing to the Upper Tribunal, as you will not be paid while doing this;

- you claim JSA

- you make a new claim for ESA

- you become economically inactive

If your GP is prepared to continue to provide you with Fit Notes you can make a new claim for ESA, which will ensure that you at least have the Assessment rate paid to you, have another look at the ESA Claim guides to see whether you can better document your daily problems,

Thank you I was told I couldn't claim only JSA and that means I'm fit to work I have give sick notes and can get in making a appointment with citizen advice also thank you

I didn't go I only had a letter if my doctor seems I wasn't prepared enough after a tribunal do you no if I can appeal again

Sorry your going through this, I am awaiting my Tribunal date at the moment but found out it can take 26weeks to get the date !! My problem is the dwp said I didn't attend my medical although over the last 6yrs I have never missed anything so I told them I didn't receive any letter to tell me about a medical.. There now saying it's my own fault that I didn't get the letter and I have to prove I didn't get it... I would love to know how I can prove that one !! I have had no money for 4 months and know how hard it is I have bills mounting up, Rent, council tax even though they all know what is going on so I went to the CAB last week and asked them what I could claim in the meantime and they told me either Universal Credit or JSA because I'm still going through my Tribunal.. So I am trying to Claim Universal Credits. If you can I would claim ESA again with your doctors backing x Good Luck x

Dear Jan-Bell so sorry to hear once more regarding ESA failed claim. I can hand on heart state that, benefitsandwork.co.uk/perso... is an amazing website . They have online manuals that helps with advice and wording for claimants, with applying and appealing rulings on benefits such as ESA and PIP .

It costs money, but it’s helped me and was the best £ 19 i’ve ever spent.

What ever advice you get , I hope one at least helps you with your appeal. Don’t give up , get on and appeal.

Oh dear I'm so sad to hear this. You need their Statement of reasons, and the clerks contemporaneous notes. Ring em and tell em that pronto. You probly need to write this too, so ask em for a nice envelope. No point getting the address wrong hey? Then you need to read through and find if they made an error in law. It is possible. You can find info to help on line. You probably need help. There may be a local law centre that use volunteer law students etc who will help you. Some wont want to do upper tier but you can ask. Depends on funding at the time.

Meanwhile, could a friend buy you some nice chocolate or an ice-cream and remind you that you are decent and worthwhile? This system is brutal. You probly need a hug or even just a mental one. Not everyone can be hugged but we all need to know we matter.

Don't despair, don't give up. They rely on that. If you possibly can, fight, and keep fighting.

If they say Oops you took too long to appeal, hard luck! Tell em the process made you sick and you can't do things quick. They have to listen to reasonable excuses. Don't let yourself get rushed and stress. You need to be methodical and work at it when you are well.

I'd also go see your GP and tell em you are scared your mood has gone too low. You need help. You might even get a support worker to help you too. I would explain to the receptionist that you need to speak to a GP urgently. You need to let your GP know your head is full and everything else is on empty.

This system is shameful. They make us feel ashamed of what they have done to us. The abusers trick that seeks to silence us.

You should be proud of standing up for yourself against a crooked system. Please don't give into despair. If you were your friend, you would sound a rallying cry and get back into the fray to fight for her.
