I am looking for a little support. I have my second tribunal tomorrow, having been awarded zero points at the first one despite letters from 3 consultants, OT and a professor and being on DLA high rate and low care for 15 years. I am 69 years old.
I appealed to the upper tribunal and my appeal was accepted, The judge said the first tribunal erred in law on 3 points, one being not even looking at my evidence.
So here we are. I also have mental health problems and today and just cant even function. Feeling sick, my mind is blank. I just cannot function when I am under any kind of pressure, I forget everything, stutter, feeling hopeless.
Has anyone been in this situation? can anyone give me any pointers. Thanks for reading.

The fact that you have been allowed a second appeal is positive, it means that a higher authority has deemed the original appeal was wrong, and needs to address your concerns. Do you have CAB or someone to go with you to appeal? I wouldn't worry about things at the appeal, because they will make sure they look at all your evidence as they know that a higher authority is watching them. Good luck.
Hi...Thank you for your reply. Yes I have my son to go with me. I only found out about my date three weeks ago and it was too late for anyone from CAB to organise. Do you know if the Higher Judge gets an update on the tribunal result?
Hi Joanna l wish you good luck, go in a wheel chair that you have to be pushed in and a walking stick, l know IT is hard l was on the high rate DLA for 9 years put over to PIP AND THEY LIE SO MUCH AND PUT ME ON STANDARD RATE, BUT since being diagnosed with fibro l let pip know as you have too, but because you are suffering enough already try to get your son to do a lot of the talking unless you have to talk then have plenty of tears ready and good luck let us know how you get on. As you well know a DLA and PIP are two different benefits awarded using two different criteria, DLA about your disability and PIP your abilities to cope manage the PIP descriptors in your daily life safely, repeatedly and in a timely manner. A lot of claimants think they should be transferred form DLA to PIP with out change, as stated different criteria for assessments.
Hi Yes l am aware of this, l have got my second PIP ASSESSMENT ON 6TH JUNE The stress gas started already, not that l am not suffering enough already, they do lie so much l just don't trust them at all. Totally scared.

Just wanted to let everyone know I was awarded high rate mobility and high rate care yesterday.
Its been a long struggle to get justice and it was all over with in 7 minutes. No questions about my mobility just 3 questions in care. They sent me out for 4 minutes and when i went back in they told me not to sit down as it would not take long and gave me the award. I burst into tears. I thought I would feel different afterwards. I did not have any tea and no wine to celebrate. I thought it would be the best feeling in the world after 2 years and 4 months of fighting their decision.
There were many times I wanted to give up, I feel like the whole process has changed me as a person, but I would say to anyone: Don't give up the fight. I asked my Consultant to support me and he did with a lovely letter telling the DWP what he thought of how they I had been treated and I got a letter from my OT who more or less said the same.
Keep fighting, and now I can ............Breathe xxxx
Dont stress just imagine them all naked in front of you and think how you are being so calm answering their questions so calmly! You won once you can do it again! U showed them and u can do it again no probs!
