Hi all,

I have ME, Fibro, severe anxiety disorder and depression and now being referred for autism assessment. I'm 48 single mum to an 8yr old boy with autism /Aspergers.

My son has had poor attendance at around 75 but improved to 80% until he was bullied and became extremely distressed (twice, but school denied it) after which I took him out of the school whereby my sister is now home educating him. He had lots of lates at the mainstream school too because of his unwillingness but admittedly also due to my severe pain and tiredness so not consistently being able to do things in a timely manner. But for every illness he was off for I contacted my GP as it was agreed. When I took him out the school decided to report me to social services "because they felt that I needed him at home, that he was at risk and that I had taken him off the school register because they were getting too close to finding out that I have mental health issues". Social services assessed and said all was well and that is was a school issue. So the school then decided to get the council to prosecute me for the period that he was at school (upto 8th April) I had to have an interview under caution and now awaiting a summons from the courts to be prosecuted under the more severe section 1A. Considering I can't attend medical assessments and go places due to my severe anxiety my fibromyalgia etc is in meltdown /overdrive. I just don't know which way to turn as I can't get legal aid as far as I'm aware and facing a possible prison sentence! I can't even use phones to talk to anyone because of memory and the anxiety I suffer from. I only have a GP, and just started seeing a occupational therapist, even though after many years of pain I was finally diagnosed in 2012. I get enhanced care and mobility pip but receive no support other than family members. I don't know what to do!!

Try cab citizens advice or a disability advisor they are free and will be able to tell you if you can get legal aid and may help you fight your case also ask your doctor for a letter re your medical conditions photo copy it and give a copy to court under your case number so they can read it. Then when all this is finished ask if you can put an injunction against the school as they are harassing you xxxxxxxxx

As Treewade has advised, go and see Citizens Advice, who will be able to help you. Good luck with everything. x
