Do I go for a Tribunal ?

As some of you will be aware I was turned down for PIP in September . I asked for a Mandatory Appeal and after they initially logged my letter then ignored it, that Appeal took place . I was refused again . One of the comments being "Mental state examination showed you were of average build , well kempt and did not look tired" , I'm not sure how any of that can explain my mental state. The fact that I could take my purse from my bag was also noted as a reason that I don't need help . I could go on , but I'll just get upset all over again . Is it worth going to Tribunal ?

I think I would get intouch with your local MP and ask for a home visit so that he/she can see how you are affected.. Mine was good for me when ESA were messing me about, good luck hope you get sorted.

Thanks NurseGladys , I've just emailed my MP and I will try and get to a drop in CAB service next week .

yes cab is a good starting point if they have a welfare rights officer my local helped me with form filling..

My advice is yes go to tribunal. I done a written submission to The Work and Pensions Committee in relations to PIP and ESA assessments one of which I have been through lately myself and got confirmation it has been published. Atos only employ 4 doctors in total and one of the reasons why people win their appeals is people with any Mental health conditions are not been examined by doctors at all when been assessed

They must have a selection of answers they use over and over again. 😂

Def go to tribunal. They only include in report what they want too.. e.g. Said I got notes out my bag fine but failed to put I couldn't get them back in and bag adapted as can't use my hands properly.

Let an independent panel be the judge and get as much evidence as you can xx

yes dont fill in forms yourself go to welfare rights . for help . take it to appeal

So I have received a very prompt reply from my MP and a case worker has asked for some details so they can look at what's gone on .

With all the current hooha going on about assessments, I am not surprised your MP has replied promptly. I watched the parliamentary debate about it yesterday. Found it quite inetersting.

Yes you go veggiehog,

you explain all your differculties you incounter every day.. And where you should of scored points.

I know it will be very stressful, but it will be worth it if your claim successful.
