Can somebody tell me how a healthcare professional (registered nurse) can overide a one's GP. I had a work capabilitie assessment at the job centre which took 80 minutes. I was awarded no points on any of the assessment. I have now got my appeal date. Should I make issue to the court that my doctor issues a sick note stating Fibromyalgia and Depression for a reason.

Go through the assessment report with a fine tooth comb and concentrate on those sections where they have ignored evidence you have out forward. Make sure also that they have got all your treatments and medication correct and if not point that out clearly as that will put doubt in the labels mind about the rest of the assessment. For instance I found on my husband's even thought he assessor had been handed his green and white repeat prescription form and told she could attach it to the evidence she actually had the amount prescribed on a very strong drug down incorrectly and at such a strength if prescribed it would have probably killed him! She had also ignored certain evidence. His points went from 0 to 18 at appeal and he had an apology from the judge for his ordeal? Best of luck let us know how you get on.x

The fact your GP signs a sick certificate is irrelevant.

If the criteria is to walk say 200m+, 100-200m or less than 50m, what you need is a doctors letter saying .. Ms X struggles to walk more than 50m without stopping for a few minutes and she can walk in total no more than 100m.

So in short go through the criteria and get your GP to comment on each point.

Unfortunately the way the assessments system is structured is to ignore the Medical evidence and instead focus on a your mobility and your capacity to perform extremely basic tasks such as brushing your hair & boiling an egg.

It can seem like unless you are completely paralysed you will be assessed as fit for employment. Thankfully it isn't quite as bad as that - yet!
