So after 8 weeks of worrying I had the dreaded brown envelope arrive on mat yesterday morning. My Reconsideration for PIP I can't believe they only gave me 6 & 4 points! Am absolutely gutted but after 29 weeks from having my niece fill out the form for me in April I really do not have the energy to fight anymore. I feel so low right I really didn't think this decision would make me feel even worse....

Hello Aim425 so sorry all that effort has not changed their decision. It really is disgusting what they are putting us through. Please don't give up. You only want what you are entitled to. Please don't give up at this stage. You have a short period to put in an appeal but it can take months to get a date for the actual appeal. By this time you might have got your fight back. Even if you can't face attending the appeal when it comes round you can ask for them to decide it based on the evidence. You can provide extra evidence until a week before the appeal date. When requesting an appeal you don't need to put a large amount of effort in to your reasons at this stage. You can be very brief simply stating something along the lines of
"I was awarded only 6 points for daily living and 4 points for mobility however I believe I provided evidence sufficient for an award of .... for daily living and ..... for mobility. I don't believe the assessor considered the reliability criteria during my assessment and overestimated my abilities as a result."
Obviously that's just guessing but I think the reliability criteria are very often a problem in assessments. For example the assessor sees someone walk a certain distance once but doesn't investigate whether they are capable of doing this again or whether it will put them out of action for days etc.

There is a stage at which if you appeal further you take the risk of losing your whole award.
We have seen this happen to a few of our members and they have ended up having their motorbility cars taken away.

I don't think Aim425 got any award for daily living or mobility based on the points mentioned.
It's true though that points can be removed at MR stage or appeal stage so if someone does have an award the decision to take the fight further has to be considered more carefully.

I am not 100 per cent sure on this, but if you decide to change your mind and want to take this to Appeal, I think you could be at risk of losing what you have been awarded.
I am sorry I can't remember which stage it is that you can end up losing your whole award.

I know and understand how you feel but please have another think in the next few days. I was a bit like that when i received 6points for Daily and 4 for Mobility at the initial decision. But after the encouragements and support from people, i persevered and appeal with Mandatory Reconsideration which was successful yesterday. I know you have done the MR and got 6 and 4. But ask yourself what have i got to loose if i try the Tribunal. It would either be the same or an award. Its just the time, effort and the emotional strain involved is absolutely difficult but try and rethink if you can fight the last hurdle. All the best
I'm with Dydy-gabb you have nothing to lose, if you have welfare rights in your town go to them for help they will help you with forms. I really hate the way we are being treated no one chooses to have Fibro and other health problems, we would rather be pain free and out in the world working away instead of stuck in our house 24/7. If it was an illness that we inflicted on ourselves we would get all the benefits under the sun and a bit extra to feed our dog, it's so unfair. We shouldn't be treated like 2nd class citizens.

When you have the strength fight back, they expect you to take this lying down. Where as the self inflicted ones don't stand for it they see it as their god given right and will fight tooth and nail for it. And like everything else they get it ( just to shut them up) you see it many a time there can be a queue so long in chemist and when they come in they are taken to a consulting room right away and given their meth oops sorry meds and off they trot. I think we have been quiet too long. RANT OVER SORRY PEEPS!!!

I was refused award for DLA, turned down for MC and lost appeal,i then won at tribunal and then lost DLA and had to do the whole thing again for PIP. I was devastated. But i did all the PIP application and got 41 points for care and 12 for mobility. Please dont give up while there is still an avenue you havnt tried.
Don't give up now, all the extra worry and pain you have been through to get this far will hopefully subside after tribunal. Good luck x
