ESA appeal.

Hello, I have been disallowed my ESA for not attending a medical, haven't been paid a penny since November 2014, I also had my appeal disallowed too.. Now I've asked for a set aside to give me more time to provide more evidence for my claim. Will I get this money backdated if they give me a set aside? How can they even declare you fit for work if you didn't get a medical!

Hey, I all ready failed that part my reason wasn't good enough even know my doctor told them I haven't left the house in over 6 yrs! and also when I have my 2 year DLA medical I get home visits and apparently ESA don't do home visits! I was asking if my appeal gets put a side will I get backdated money from November when they stopped it?

Have you been in touch with your local CAB? They are the people with the expertise in applying for these benefits and should be able to advise you. The Benefits and Work website has ESA information & you may find something on there.

I went through a similar thing where they deemed me fit to work when I clearly am not. They kept paying my ESA at the assessment rate while it went to appeal. They didn't tell me that I needed to represent myself and so the Tribunal just read the ATOS report and threw out my appeal. Because it had been over 6 months, you are allowed to make a new claim for ESA, which went through with no problem, however they would not back date my claim to the start of the original one, just to the start of the second claim. I still believe that this is an exercise to wean out the fakers as only genuine people will appeal, also it saves them money for the months it goes through appeal etc.
