I have just had my Appeal for ESA allowed as they said section 29 applied. Does this mean you go in the Support Group?

I believe it does, did you not get advised of this?

If section 29 applies it means there is significant risk to your mental or physical health if you are not found to have limited capability for work, so you must automatically be put into support group.

Thank you, no I didn't get told this I should have asked but I have been so stressed over all this especially when they stopped paying me anything at the end of March.I just hope they sort it out soon. This new system doesn't seem to be working fairly for people.

No ATOS & DWP aren't exactly known for being fare to people.

This must be such a relief for you. If you have appealed and won then you should also get back pay.

I have my own appeal on Thursday -fingers crossed, so I know just how stressful it is

Good luck for Thursday. I wrote to the tribunal people and told them exactly how my life is "warts and all" and they said that had helped.

I'll be thinking of you on Thursday.

try to get someone who can back you up! like an ot or other pro, when you go in they will be watching your movements all the time, hope it goes well x

Thanks for the good wishes. I got a letter from a therapist, but no-one to go with me. I can only go along now and try to convince them what it has taken me over 2 years to accept, that holding down a full time job now would be impossible

Hi Maladjusted

Congratulations on a successful result, Section 29 as you quote is also called "Rule 27" and is a very good little trick to have up your sleeve when attending appeals, but just to help other guys out there, it can backfire on you if you don't have the medical backup from your GP or consultant stating what it says.
