Can my husbands employer dismiss him due to ill health. He has Fibromyalgia and Hypermobility.

I guess the short answer is yes. But they should have a process to go through. The issue is, is your husband able to fulfill his contract of employment or is he having to take a lot of time off sick. Are there reasonable adjustments that can be made to the job or the environment (different hours, special chair that sort of thing) that would help him work. If that is the case and they have followed their own procedures, then there could be an outcome of 'dismissal due to ill health'. If that is the case, is there a work's pension and could he claim ill health retirement? He probably needs to speak with managers or personnel, get the relevant policies, get a referral to occupational health and see where that goes. I hope that is helpful.

Thank you. We will ask his work place about the ill health retirement pension. He is only 40? Does age matter?

Hi Chez1000, I was dismissed in 2007 due to ill health. I had worked for the same company for 30 years - 4 days. I was luckyenough to be in the union so had support from them. I was off sick more than in work which started in 2005 but hadn't had a firm diagnosis from my consultant so only got a ILL HEALTH PENSION which is reviewed ever 2 years. I have since been diagnosised with Lupus, Raynaids, sjogrens, oseoarthritis, plus more. To date I'm still reviewed every 2 years as my empoyers seem to think i'll get better (they live on a different planet them us).

I really do hope your Husband get the ill health pension as this will help pay bills etc and will help take some of the stress away which he's most probaly having right now.
