if your condition gets worse while wating for an appeal do you have to put in a new claim and lose the chance of any backpay

I went to tribunal last year and my condition had continued to deteriorate whilst I was waiting. the judge told me to apply for a suppression, so that I would not lose backdated pay owed. I just kept sending in new information for my case. My file must be massive by now as during this time I had a care package start too.

So no, I didn't have to put in a new claim. Might be worth contacting them and see what they say about the stage of your claim and if you need a.new one or CAB.

I am waiting on a tribunal date,my condition is 10 times worse than it was when i first claimed in 2011(Been refused 3 times!!)

I rang benefits advice line who told me to put a new claim in,guess what?? within 2 weeks i got a refusal saying they had used the info from an ATOS medical i had in July 2012!! So im trying to find out if this is legal as they didn't even request up to date info from my GP,I cant function properly on a day to day basis,just when i think im improving i do the housework etc & its puts me straight back to square one. Im sick of DWP accusing me of being a fraud!

I was told they had to treat a new claim just as it says..A new claim...But as you can see,that's not what they have done in my case!!

hi ,i put in a new claim for care side of DLA and they refused,the reasons they gave were,,information i gave{?!} plus the medical assesment from ATOS....eerm i had an opology from ATOS saying the report had many inconsistancies so to disregard it!!! and that DLA had been informed!! when i rang to point this out suprise suprise DWP had not recieved said letter...even tho it had been sent in an email to a specific person!! so after two more weeks of faffing i was asked to send letter in again..one week later after i sent copy by recorded delivery...hey presto!! they hadnt recieved that!! it had been signed for TWICE but now could not be found!!! anyway i have now got it sorted...i think! i rang to check and was told they were waiting for a report from my doctor and mental health nurse..i asked why as i had sent letters from them with my claim..was told the decision makers had requested it...i gave them a week and rang again..oh yes my claim was now with decision makers..i asked if they had everything was told to hang on please...she came back and said oh yes i have your claim pack in front of me and every thing is in order..eerm if the decision makers had my forms how had she got them!!!! ah well im going to ring tomorrow to check again...sorry for the rant..but it just shows how slack the DWP are!! and if i hadnt rang i wouldnt have known my forms had disapeared!! will keep you posted xxx

Please do I feel like just given up they just want to gind you down.This the fist time in my whole working life I have ever asked for any help but it feels like i am on some sort murder trial!!!

i know how you feel i was told i didnt qualify for dla and had to go for a medical for esa and they put me in the work related one now ive got a woman coming to my house on tuesday coz the dwp think i should be on job seekers even thou ive got fibro/ ME im in loads of pain everyday i had to give up my job because of the amount of time i was having off and when i did turn in i got sent home its so frustrating krrp going for mrdicals and getting no where
