Hi I had a heart attack at the age of 42 due to family history. I was the diagnosed with sleep aponea and fibromyalgia. On application for DLA I was awarded only low care rate, previously on low rate mobility and middle rate care. I am confused and feel like giving up. Can anyone give me any advice.

Don't give up, that's what the DWP are quite happy for you to do cos you'll save them a few bob - I actually think they are twisted enough to do it deliberately in the hope that they can wear folks down!

You must tell DWP within one month of the date of the decision that you wish to appeal. You also should try and get to a CAB for some advice - however, they'll tell you that you have to weigh up what you've already got against the fact you may lose it on appeal. Once you put in an appeal it will automatically go for reconsideration (ie it's looked at by another Decision Maker).

Check your decision letter and find out what they based their decision on (if I remember rightly it's on the reverse of the first page) - make sure they have contacted your GP/Specialist/Consultant & have taken into consideration any reports or other evidence that you have sent. Have a look at your copy of your claim form (if you don't have one ask the DWP to send you a copy) and go through it with a fine tooth comb and see if there's anything you've missed or any points you need to clarify.

If you've told them your condition has deteriorated try and get confirmation of this from your GP and/or Consultant/Specialist. Did your heart attack come before or after your original application?
