Iv just won my appeal for mid DLA-care. My ESA is also awaiting appeal!! Can I receive the backdated care comp while ESA is under appeal??

ESA and the DLA are 2 different benefits. You should receive your DLA within a couple of weeks. I would ring there office and ask how long you due moneys will take.....after all its yours :)

Have you informed ESA (JCP) about your change in circumstances. Getting the DLA may mean they will accept you should be in the support group. You will not get any backdated money from ESA until either your decision has been changed by the JCP/DWP or you win an appeal at a tribunal. Good luck. Hope this helps. Don't give up with ESA get onto them now with your information.

Hi Jack, Thanks for that. ESA have been informed that I won my appeal tribunal to not only maintain the lower level of DLA but that it was also increased the middle rate care level. They have also been sent a copy of the tribunals decision. Do I still have to wait for the appeal date for the ESA or should this now be over ridden and I can receive the backdated care component that I should now be eligible for also?? Thanks heaps you're a star.

I'm not a benefit specialist, just know what I went through... I would think that the tribunal will inform DWP in their own sweet time ( I was lucky I only waited 2 weeks!) and they (JCP/DWP)will notify you of the change to the decision regarding ESA group and financial levels and will at that point sort out any backdated money due straight into your account. The money was in my account before I got the letter. Tribunal tells DWP what the score is. Good luck and good news. Onward and upward.x

Yeay thanks Jack, that sounds promising.My winning appeal tribunal was 3 weeks ago. They've sent me thru the backdated DLA but i'm told that on the level of DLA that i'm now on that entitles me to a different rate ESA. But wasn't sure what ESA would do with them taking me to a tribunal also, which iv not even got a date for yet. I'm at a loss with all this benefit stuff, goes straight over my head so your help is greatly appreciated. All I can work out is that the wrong people seem to get taken to tribunals!! Thanks again.

Scoopi what should happen is that the ESA will be at the support group level and should not require a separate tribunal. You should hear from them soon. If not I would give then a phone or write to them and state the DLA award. If possible send a copy of your award letter from DLA Tribunal. The system is complex to put us off, i'm sure. Take care.

Saphie. Try the "Direct Gov" site it explain the different benefits. A website called "Turn2 us" is also very helpful for not only benefit info but they have a benefits calculator so you can check what you may be entitled to. Good luck.
