ESA, PIP, DLA Issues?

Has anyone had an recent issues with any of these, I ask as recently as March someone at the DWP decided to delete my account, they then re-created my account from very old data that wasn't accurate and now I'm on the wrong variation, which means I've lost access to 'Free Medication' that I was entitled to.

It's an absolute nightmare to try and sort and so was wondering if anyone else had issues in UK?

Also a bit of advice around working and permitted working, most of what is written is an outright lie and incorrect, I've found this out over the course of the last 14 weeks sorting the mess out.

ESA: 16 hour "permitted" work | partner 10 hours MAXIMUM

DWP will tell you it's 20 hours, as they don't take into account the first 20 hours, they might not, but everyone else does, including your local authority.

16 hours is written in most cases of DWP documentation, however for ESA, this is also incorrect if you are also in receipt of CA, as the maximum hours is 10 or less than £139.

Your local authority attitude, is all hours are counted and not discounted and will be reflected against your housing, this also includes CA as an income and so if you don't get the 'ESA' top up, well guess what, your not entitled to 0 with the local authority.

Just a heads up, as I'm going through all this at the moment.

Hi, know how you feel with the dwp, I have to chase everything up with them, I'm currently going through a complaint procedure with them, my case started in 2020, and only resumed because I chased it up, all done, but no backpay, had to ask for award letter to be told I had to write a letter explaining why I'm entitled to the back pay they owe me, disgusting, as I've been ignored after doing that, I've now complained, wish me luck xxx

You can bring a tribunal against DWP, wait till you get the first response to your complaint, then ask for a reconsideration to the complaint and then issue it to the courts.

Sounds like a nightmare, I had similar troubles though not as bad a few years ago, thankfully I'm retired now. I found this site very helpful: benefitsandwork.co.uk/

They've always been bad, even back when they were DSS. I worked for DWP before having to come out of work, they are not the best employers either.

Sorry to hear the system is still as complex as ever its what I call the modern virus "the computer says" But the computer is usually inputted by humans or changed by humans and it only takes a small typing error to mislead the next person who uses it. This includes our own digital items . However this does not help the customer while they are waiting to manage their finances especially if what you were getting passports you to other help . I recall many years ago mine being stopped altogether for no reason fortunately my husband had income coming in till it was reinstalled on the computer. I hope you soon get it sorted and good luck to you and the others on this post .

I was in a similar situation and basically I put in a statutory access request for all my records both written and verbal(phone calls). Armed with this I asked for a full explanation why my records had been lost. I then complained to The Information Commissioners officer that the DWP had failed in their duty of care to protect my personal information which they have a legal statutory obligation to do. Accidentally erasing them is not acceptable. You will find the ICO will take your complaint very seriously. So will the DWP as they have to pay for the ICO investigation.

I’m just starting on my benefits journey, submitting a PIP application on line, having received a confirmation email and then ad week later, a letter basically telling me that they’d not received my application. After 57 minutes of hanging on the line a 30 second check by the human answering my call confirmed they had indeed received everything and to ignore the letter. Great start! Also applied for ESA as SSP had finished after 28 weeks but have now had my employment terminated by my employer.

Good job I’m not at work, all this is a full time job!

I was on pip and esa for some reason they stopped my carer so was on high mobility and low care i appealed a year later and got it back they would not pay back for the low care then just put it back to high i did not want to quetion it at time i was pleased to get it back they say i could lose both not good enough scare tactics unreal what some are not getting right amounts you are so stressed any time with the forms you darnt complain but i wised i challeged it but the fier we have so never give up is my message it is made to almost reapeat so it is very hard for us to focus as were in so much pain my pain killers are still weekly the pain nurse i had she did not understand chronic pain she said i sold my pain meds why would we do that when we need themi tried to fight it but ended up no further lousey i did for a year figting to no further on brick wall came up i have had been ill since i was 30 onwards they do not care you feel alone so keep fighting where and if you can never give up is my mantra cos somone will help it is such a mine field good luck let me know how yer doing i am 62 september years have gone fast unreal sorry for talking so much i wanted you to know the road i had power citizens advice on phone did what they could shocked at the levels we goto were just telling the truth txt me if i hope i helped in small way Romayne.PS Best of luck any help please txt if i am able to help from years of fighting the system hope i was helpful any quetions please ask away all the very best for you take good care Romayne.

Hello Mapadale, you certainly have had a huge knightmare with the DWP haven't you.I would suggest contacting DIAL.

They are fantastic at helping with your PIP & EESA claims. They can even come out to your home and help with all the complications that you have had so far, and help to complete the forms.

As they've been doing this for several years, they know just the right words to use and how to describe your disability in a way that the DWP understands.

They certainly helped me.
