PIP RECONSIDERATION....

Got my reconsideration for Pip a few days ago, was another zero points of daily and mobility. This time the DM said in summary I opened a door with right hand...I am left handed with left hand and lead with the left. And as far as I can remember my daughter opened all doors for me.

My diary and letters written by family as to who I am affected on a daily basis according to the DM did not fit with my "disability". I have vertigo and attacks can hit you at any time. and although they only last a short time, the after effects of feeling and so and off balance and sick last a lot longer.

The DM stated that they and the assessors are highly trained in disabilities and how effect they individuals. Not sure totally on that being correct. Because I know doctors from all over the world are writing patients off who suffer from chronic mesh pain, off as being delusional and all the pains are in our heads.

I am due to go back to surgeons to get help for my chronic pain.

DWP will be made aware of this and how this was ignored at medical, all this will be brought up at Tribunal.

Original letter from DWP made out I was 100% okay. Reconsideration letter now says majority of time I can manage. And how I can walk on uneven ground and slopes... that was hilarious... flat ground is bad enough....

Hi Liz,

you sound like my first PIP assessment was but when I eventually managed to get through to a supervisor and I told him that what his assessor wrote down was nothing like how I answered him and nothing like how I was on the day I added that if he wants then I can send them the recording which was on my cctv system but they just sent round another assessor and after this one they put me on the lower care rate and higher mobility rate not bad considering they first said I was not entitled to anything.

I believe that all the assessors are told to fail everyone straight away and if you complain then they take a look how you really are, after my second assessment they replied by telling me what they had put me up to and that they did not want to see me for 10 years as there was no way I would improve, just keep at them and don't give up you will win in the end.

another thing they do is if they award it to you on the second time they only back date it to when you asked for a appeal and not back to when you first applied which for me was only 6 months and not back the 3 years it has taken to get a decent assessment but it is better than not getting anything.

Did you give DWP any doctors letters?

Hi Paul,

it does not bother the DWP if you give doctors letters xrays MRI results or any other evidence from what I have had happen to me and to many many other people they always seam to give the result that you do not need any help no matter how bad you are they are a law unto themselves I gave doctors letters gave my permission for them to obtain all my medical documentation provided my pain diary for over two years they knew how bad I was but the assessor put down that I did not have any problem with either mobility or care even though I had shown him that for most of the time could not even get out of bed on my own whilst he was here in my home he saw how I had trouble getting to the front door when the post lady came and saw also that I collapsed on the way back from the door (it is less than 3 yards from my seat to the front door) and I also had to just drop the small package I had just received which was around 3 or 4 ozs he put down I stood up with no problem and walked to the door which was over 5 meters away and returned with a large parcel showing no problem or distress even though I broke down crying due to pain and could not speak to him for over 5 minutes when I received their reply and I phoned up and told them I had the interview on my cctv system they decided to arrange a new interview but they tried to get me to go to them instead when I phoned them stating there was no way I could get to the location in Nottingham due to it being on a clear way and in a pedestrian only area and the closest parking was around 1/2 a mile away they said they would arrange another interview and stated if I do not turn up for the next one they will consider my claim closed when they called with the next appointment which was at the same place and again I told them that I could not get their they said they will send me a letter showing how I could get there using public transport I replied it is not getting to the area but trying to get from either my car, taxi or bus stop which was the problem they then arranged another interview in my home which was done by a young girl and she put down how bad I am not what they wanted to believe and a week later they sent me a letter stating I was now on the lower standard for care (there is only 2 standards for care now, lower and higher) and higher rate for mobility which is a large jump from stating that I did not need any help with either but they only back date it to when they had decided i did not need any help and not back to when I first applied which was what I was told at the start which is in my opinion the reason they refuse everyone on the first application for me it took just less than 3 years from when I first applied until when they agreed I did need help which saved them £14,208.90 and if you think how many people are in the same position it must come to several million.

Hi liz 62, sounds like nothings changed much in the assessment area. I recall many such anomalies during my lifetime of working with disabilities that were construed as minor to put it simply. You have my best wishes for the battle ahead, I eventually won when they retired me early from employment, so good luck.

Good luck. The DWP want you to fail in your application and will lie to achieve this. Have you got representation for the tribunal? You need to go through the CAB to apply for FRU (free representation unit) if the DWP send one of their tortoises along to the case, they and the judge will talk over your head in Latin and you won't be included. The best result would be if you can convince your doctor to write a very definite letter stating that you cannot do anything unaided most of the time. Also make a video of your day on tape or better still cine film if poss with no editing.

Record the tribunal if you can with tape or cassette. The tribunal is part of the same machine we are being put through and these people actually want you dead if they can arrange it so IDSmith can get a wider grin as more die and he public will not know how many.
